OSCN Found Document:Jennings v. Natrona County Detention Center Medical Facility
Jennings had "on three or more prior occasions, while incarcerated, brought an action or appeal in federal court that was dismissed as frivolous or for failure to state a claim." Consequently, Mr.
Jennings' appeal from the district court's dismissal of his March 1998 complaint against the Natrona County Detention Center Medical Facility was pending, we conclude the district court erred in counting its dismissal of that complaint as a strike.
Jennings' statements the officer was affecting his "progress in such a way that the situation is never solved" and making his "stay a very bad one," are vague and conclusory.
