 United States v. Kelley
On appeal of his sentence, Kelley argues (1) that the district court erred in determining the amount of the loss for sentencing purposes, and (2) that the district court abused his discretion in denying a two point offense level reduction for acceptance of responsibility.
Kelley argues that the district court's conclusion that the S.B.A.'s loss ranged between $20,000 and $40,000 was clearly erroneous in light of evidence adduced at trial.
Specifically, Kelley argues that the sentencing court must accept the value of the collateral to the defendant, rather than the victim lending institution, and that he should be credited for the full $35,000 in equity he could have obtained if he sold the house on the open market.

Edward Kelley (also spelled Edward Kelly)(1555 - 1597) was a spirit medium who worked with John Dee in his magical investigations.
Kelley's association with Dee came to an abrupt end in 1589, when Kelley claimed to have received orders from the "angels" messages suggesting that they should share everything — including Dee's wife.
Kelley's flamboyant biography, and his relative notoriety among English-speaking historians (chiefly because of his association with Dee) may have made him the source for the folklorical image of the alchemist-charlatan.

Specifically, Kelley claimed that he had acquired in England small amounts of two powders, one white and one red, which had allegedly been found in Wales, in the raided tomb of a Bishop.
Kelley also carried with him a cryptic manuscript, which he claimed had been found with the powders, and which presumably held the secret of their manufacture.
However, Kelley eventually ran out of his magic powders, was jailed by Rudolf in a tower of his castle, and died of injuries sustained in an extravagant escape attempt.

Dee tested Kelley's abilities as a scryer and was very pleased with the results: Kelley was able to contact the angels and describe his visions with remarkable fluency.
Kelley vividly described his visions; sometimes they were so frightening to Kelley that it was only with great difficulty that Dee could coax him into continuing.
After he left Dee, Kelley did become rich for a time: he was celebrated as an alchemist and handsomely rewarded with land and titles by Rudolph, and sought after by Elizabeth, though in the end he was imprisoned for his failure to produce gold.

So it was with Kelley, who would almost certainly have disappeared into the mists of time had he not become involved with Dee, something of a celebrity in his day.
Kelley had originally visited Dee in the hope of securing his assistance in making use of some alchemical powders - one batch of red and one of white - that he had acquired along with a cryptic magical instruction manual that explained how they could be used to manufacture gold.
Historians are inclined to recount Kelley's end with a level of smug relish that contrasts starkly with the sympathetic tone adopted to relate Dee's descent from royal favour into poverty.
