Hence it appears, that by the common law every man had an equal right to such creatures as were not naturally under the power of man, and that the mere caption or seizure created a property in them.
Also, the common law warrants the hunting of ravenous beasts of prey on another=s ground, such as foxes, wolves, badgers, andc., so that the party in pursuing those through the grounds of another is subject to no action whatsoever.
Thus it appears by the common law, that a property in those living creatures, which by reason of their swiftness or fierceness were not naturally under the power of man, was gained by the mere caption or seizure of them, and that all men had an equal right to hunt and kill them.

Bentham figured that laws should be socially useful and not merely reflect the status quo; he thought it to be a "sacred truth" that "the greatest happiness of the greatest number is the foundation of morals and legislation."
Leoni demonstrates, through historical evidence, the role of law in a Free Society; and how common law, which among individuals encourages "spontaneous adjustment" by its tradition, tacit rules and private arbitration, is being replaced with written, or legislative law, a type of law which leads to the destruction of individual freedom.
