Torres is alleged to have created a scheme to defraud by offering high-yielding Los Angeles and Orange County municipal bonds for investment and receiving clients' payments for the purchase of those investments, when in fact he had no intention to purchase and did not purchase said municipal bonds.
Torres is alleged to have used his status as a member and past president of the Moraga Chamber of Commerce and a member and past president of the Moraga Rotary Club to engender trust and confidence in his victims.
Torres is charged with depositing his clients' funds into his personal bank account and keeping investors from complaining to law enforcement and SunAmerica by mailing and wire-transferring checks as purported interest payments on the bonds.

U.S. Magistrate Judge Edwin Torres set the bail amount for Ze'ev Rosenstein over the objections of federal prosecutors, who said they were concerned that Rosenstein had ready access to huge assets and could readily flee the United States.
But Torres said he was concerned about allowing Rosenstein to be held without bail or even a detention hearing for such a lengthy time since his extradition from Israel in early March.
The judge added that even if Rosenstein, whom the Israelis liken to gangster Al Capone, could make the $10 million bail he would hold another hearing to set other conditions before he is released.

After some admonishment from U.S. District Court Judge Robert E. Keeton, the city last month was ordered to pay a $5,390 fine for withholding documents requested by the attorney for Edwin Torres Colon, Juana Colon Hernandez, Wilfredo Torres and Wendy Alexander.
But Judge Keeton pointed out that the city did not object within 30 days of the original request and that the records should have been turned over for both the plaintiff and the court to consider well before July.
Judge Keeton's ruling required "the reimbursement of the expenses that were caused by the necessity of filing (plaintiffs') motion."
