 C.P. v. Allstate Insurance Company (3/3/00) sp-5245
It also alleged that the elder Lancasters were negligent (in failing to disclose Harold's presence or his alleged propensity to assault children and in failing to watch over C.P.), and that "[a]s a direct and proximate result" of the elder Lancasters' negligence, the plaintiffs suffered damages.
Allstate reasons that the elder Lancasters' purported negligence was only "an antecedent contributing circumstance," and "not the proximate cause of the loss." In essence, Allstate reasons that because Harold's conduct caused C.P. to suffer injury, it is irrelevant that his parents' independent conduct also allegedly contributed causally to the loss.
From the standpoint of the elder Lancasters, it is not unreasonable that their interpretation of the policy focuses on the acts C.P. attributed to them, as distinct from the acts she attributes to Harold.

Eleanor McEvoy has a likable voice and the lyrics are easy to relate to.
But no, I suspect the real truth is simply that Eleanor has the soul of a poet wrapped in the body of an incredibily talented singer-songwriter, and the combined package is hard to beat.
I first heard of Eleanor McEvoy through her enchanting song "Wisper a Prayer to the Moon" featured in the often played on cable movie "The Nephew." I tracked down her 1996 album "What's Following Me" (which featured that song) and found it to be excellent -- a combination of moving lyrics and haunting music.
