 The Future of Electricity Provisions
Electricity is often traded over the system through "wheeling" transactions, in which electricity is injected into the network at one end by the transmitting utility, and an equivalent amount is removed at the other end by the receiving utility (the electrons are intermingled throughout the grid).
But as the 1980s progressed, utilities were prodded by environmentalists who wished to reduce energy use, and state regulators to use DSM as a cross-subsidy mechanism, raising rates to energy users to fund their energy efficiency programs; DSM was transformed from an investment in avoided plant costs to a hidden tax on electricity users.
Opponents of competition in electricity invoke the metaphor of the regulatory compact." According to this conception of public utility regulation, ratepayers have a morally-binding contract with utility shareholders, in which ratepayers are obligated to pay "nonconfiscatory" rates, affording the utility shareholders a "fair" rate of return on their investments.

Depending on the population served by the water system, the utility may be a small plant in a rural area that requires the occasional monitoring of a single operator or a huge system of reservoirs, dams, pipelines, and treatment plants, requiring the coordinated efforts of hundreds of people.
Formerly, utility companies operated as “regulated monopolies,” meaning that in return for having no competition, they were subject to control by public utility commissions that ensured utilities acted in the public interest and regulated the rates they were allowed to charge.

The Electricity Act, 1998, which received royal assent on October 30, 1998, provides for the payment of a transfer tax by municipalities and municipal electricity utilities that sell real or personal property used in connection with generating, transmitting, distributing or retailing electricity.
To facilitate transfers between and amalgamations of municipal electricity utilities, the transfer tax will not apply to transfers from one municipality or municipal electricity utility to another until November 7, 2000.
A transferor is permitted under the Electricity Act, 1998 to deduct certain amounts in determining its transfer tax liability in respect of a particular transfer.
