Entercom has moved for dismissal of the suit recently filed by Eliot Spitzer against the company for fraud and deceptive business practices.
Entercom’s lawyers say the attorney general must prove that consumers were harmed as a result of material deception and that because radio is free, there can be no harm.

PHILADELPHIA (AP) — Entercom Communications (ETM), the nation's fourth-largest radio broadcaster, said Monday that it is buying 16 radio stations in five states for $292 million in cash.
The acquisition gives Entercom an entry into the Austin and Cincinnati markets for the first time and adds to the company's presence in Memphis, Rochester and Boston.
Entercom will be selling at least two stations in Rochester to comply with ownership limitations set by the Federal Communications Commission.
