Equal Rights Amendment - Wikipedia, the free encyclopedia
The Equal Rights Amendment (ERA) was a proposed amendment to the United States Constitution which would have guaranteed equal rights under law for Americans regardless of gender.
Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.
In 1923, Paul drafted the Equal Rights Amendment and presented it as the "Lucretia Mott Amendment" at the celebration of the 75th anniversary of the 1848 Seneca Falls Declaration of Sentiments.

THE EQUAL RIGHTS AMENDMENT: U.S. CIVIL RIGHTS COMMISSION
Laws giving husbands exclusive rights to control aspects of the marriage still exist in States such as Oklahoma, where a statute provides that the husband is the head of the household, that he may select any reasonable place of residence and the style of living, and that the wife must conform to his wishes.
For example, laws that give the husband alone the right to recover damages from a third party who negligently injures his spouse, or for the wrongful death or injury of their child, would be extended under the ERA to give the same right to the wife.
Even where the husband is the "sole provider," the court reasoned that the State's equal rights amendment requires recognition of the contribution of the homemaker wife and concluded that, in the absence of evidence to the contrary, it must be presumed that the property is held jointly.

It is time we act to assure full equality of opportunity to those citizens who, although in a majority, suffer the restrictions that are commonly imposed on minorities, to women.
However, changes are being made so rapidly as a result of title VII of the Civil Rights Act of 1964, it is likely that by the time the equal rights amendment would become effective; no confliction State laws would remain.
The 1964 Civil Rights Act and the 1963 Equal Pay Act are not enough; they are limited in their coverage -- for instance, one excludes teachers, and the other leaves out administrative and professional women.

The Equal Protection Clause of the 14th amendment of the U.S. Constitution prohibits states from denying any person within its jurisdiction the equal protection of the laws.
By denying states the ability to discriminate, the equal protection clause of the Constitution is crucial to the protection of civil rights.
Generally, the question of whether the equal protection clause has been violated arises when a state grants a particular class of individuals the right to engage in activity yet denies other individuals the same right.

For over one hundred years after its adoption, the Equal Protection Clause was never used by the Supreme Court to invalidate a gender-based classification.
Four members of the Frontiero Court applied strict scrutiny, but other justices rejected that approach, arguing that the pendency of the Equal Rights Amendment was a factor in their decision.
It being widely assumed that the effect of the ERA would be to compel application of a strict scrutiny test to sex classifications, several Court members suggested the appropriateness of waiting for the constitutional amendment process to work its course.

It is important to note that marriage provides over 1,000 rights, obligations and protections at the federal level, and more than 300 at the state level.
Civil unions guarantee almost none of these rights, and what rights are provided disappear once a same-sex couple crosses state lines.

Then, in 1972, the Equal Rights Amendment, which had languished in Congress for almost fifty years, was finally passed and sent to the states for ratification.
The wording of the ERA was simple: "Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex." To many women's rights activists, its ratification by the required thirty-eight states seemed almost a shoo-in.

The push for equal rights was led by the National Women's Party (NWP) who succeeded in 1925 in convincing Congress to hold the first congressional hearings on the Equal Rights Amendment (ERA).
She introduced the first version of the Equal Rights Amendment to Congress, arguing that the purpose of the amendment was to allow women to be all that they could be.
Opponents to the Equal Rights Amendment pointed out that the 14th and Fifth Amendments to the United States Constitution contained guarantees of equality and that existing laws, such as the Civil Rights Act of 1964 and the Equal Pay Act provided practical protections of rights.

It is true that part of the problem has been that women have not been aggressive in demanding their rights.
As in the field of equal rights for fls, Spanish-Americans, the Indians, and other groups, laws will not change such deep-seated problems overnight But they can be used to provide protection for those who are most abused, and to begin the process of evolutionary change by compelling the insensitive majority to reexamine it's unconscious attitudes.
A second argument often heard against the equal rights amendment is that is would eliminate legislation that many States and the Federal Government have enacted giving special protection to women and that it would throw the marriage and divorce laws into chaos.
