  Ernst Torgler - Wikipedia, the free encyclopedia
Torgler subsequently became deputy chairman of the KPD Reichstag faction in 1927 and chairman in 1929, a position which made him one of the most powerful members of the party.
Torgler’s political career ended in February of 1933, however, when the Reichstag was set on fire.
Torgler was kept in custody without being charged until July of 1933, at which time he was charged with arson and treason.

Ernst Torgler (Berlijn, 25 april 1893 – Hannover, 19 januari 1963) was een Duits politicus die vooral actief was in de periode voor en in de Tweede Wereldoorlog.
Torgler had de dag voor de brand de Reichstag als laatste verlaten en was – na het vernemen van de brandstichting – die nacht buitenshuis gebleven uit angst voor arrestatie.
Torgler had toen opnieuw een maatschappelijke positie verworven maar stond nog steeds onder toezicht van de Sicherheitsdienst (SD; de Duitse veiligheidsdienst).

In the wake of the Reichstag fire Dimitrov, together with his fellow Bulgarians Popov and Tanev, Reichstag deputy Ernst Torgler and the deranged Dutchman Marinus van der Lubbe, were arrested and charged with participation in a plot to set fire to the Reichstag.
The Nazis although in power were still feeling their way towards the establishment of a totalitarian state in Germany and they decided to put Dimitrov and the others on trial.
The Bulgarians were offered asylum in the Soviet Union and moved there, Torgler was rearrested on release from the court and sent to a Nazi concentration camp.

One witness placed Ernst Torgler in a Friedrichstrasse restaurant on the night of the fire and completely discredited van der Lubbe's Communist standing.

As well as Lubbe the German police charged four communists with setting fire to the Reichstag.
This included Ernst Torgler, the chairman of the KPD and Georgi Dimitrov of the Soviet Comintern.
Marinus van der Lubbe was found guilty of the Reichstag Fire and was executed on 10th January, 1934.

Dimitrov’s undaunted conduct in court, in particular, added to the embarrassment for the Nazi leaders.
The Reichsgericht passed its verdict on December 23, 1933: “The accused Torgler, Dimitrov, Popov and Tanev are acquitted.” Marinus van der Lubbe, the only “presentable” culprit, was sentenced to death and executed on January 10, 1934, despite the existing expert opinions and testimony which conclusively ruled out the Dutchman as the sole perpetrator.
Hans Bernd Gisevius, who had worked as a junior lawyer for the political police from August to December 1933, made the following testimony at the Nuremberg War Crimes Trial in 1946: “It was Goebbels who first came up with the idea of setting fire to the Reichstag.
