The 16th (11th ordinary) session of the Administrative Council of the Eurasian Patent Organization (EAPO) was held in Moscow, Russia, from 15 to 19 of November, 2004.
In the headquarters of the Eurasian Patent Organization (EAPO) in Moscow the official meeting of the President of the Eurasian Patent Office (EAPO) Dr. Alexander GRIGORIEV with a delegation of the European Patent Office (EPO), headed by the EPO President Professor, Dr. Alain POMPIDOU, was held.
The 15th (5th extraordinary) meeting of the Administrative Council of the Eurasian Patent Organization ("the Organization") was held in Moscow, Russia, from 9 to 10 of February, 2004.

The Eurasian application filed through a national Office shall have the same effect as if it had been filed with the Eurasian Office on the same date, provided that it is transmitted to the Eurasian Office within the time limit prescribed in the Patent Regulations.
The Patent Cooperation Treaty and its Regulations shall be applied in the Eurasian Patent System and, in the case of conflict between them and this Convention and its Regulations, the former shall prevail.

Where the use of a patented invention requires, in accordance with legislation in force, the authorization of a competent authority, the term of the invention patent may be extended by Kazpatent, at the request of the patent owner, for a period not exceeding five years.
If the patent owner fails to furnish proof to the effect that non-use of the invention is justified by reasonable grounds, the court shall grant the said license and shall determine the time limits of the use, the amount and terms of payment.
The notice of the patent owner shall be valid within three years from the date of publication of the particulars of the notice in the Gazette.

(3) The organs of the Organization are the Administrative Council and the Eurasian Patent Office (hereinafter referred to as “the Eurasian Office”).
(10) The grant of a Eurasian patent shall be subject to the payment of a fee to the Eurasian Office within three months after the date on which the applicant receives notice from the Eurasian Office that it is ready to grant the Eurasian patent.
The Eurasian Office shall be a receiving Office, and also a designated and an elected Office, under the Patent Cooperation Treaty and may, with the authorization of the Administrative Council, apply for the status of International searching and Preliminary Examining Authority under the Treaty.

 Eurasian Patent Convention
Eleven former USSR republics (Estonia, Latvia, Lithuania and Turkmenistan being the exceptions) have signed a convention for the establishment of a Eurasian Patent Office which will be set up in Moscow.
The intention is that a single patent application will be able to be filed and prosecuted in Russian and give rise to a single patent that will be enforceable throughout all of the designated states.
The term of patents to be granted under the convention will be twenty years from filing and foreigners will be able to file applications either directly with the Eurasian Patent Office or through PCT.
