  European Court of Auditors - Wikipedia, the free encyclopedia
The European Court of Auditors is one of five institutions of the European Union.
The Court of Auditors checks that all the Union's revenue has been received and all its expenditure incurred in a lawful and regular manner and that the EU budget has been managed soundly.
The Court was established on 22 July 1975 by the Budgetary Treaty of 1975.

Its main brief conferred by the TCEE is to control the good implementation of the budget of the European Union with the aim of improving financial management, and reporting to the citizens of Europe on the use made of public funds by the authorities responsible for their management.
The Court of Auditors has the right of access any information it requires to perform its audit that is carried out in liaison with the national audit authorities or with the national departments responsible in the member states.
The Court of Auditors has no juridical powers and for this reason, when auditors discover cases of irregularities or frauds, including suspected fraud, the information obtained is communicated quickly as possible to the Community bodies responsible in order that they may take the appropriate action.

 European Court of Auditors reports favorably on implementation of EU aid to Kosovo
The Court of Auditors Report was published in the Official Journal of the European Communities on December 13, 2001.
The Court also obtained reasonable assurance that the financial accounts for the financial year ended December 31, 2000 are reliable and that the underlying transactions are, taken as a whole, legal and regular.
The recommendations of the Court of Auditors included: the computerization of budgetary accounts; the clarification of the role and responsibilities of the European Agency for Reconstruction's Governing Board with respect to the Agency's Management Committee; the setting up of policy framework and strategy by UNMIK to ensure the sustainability of EU-financed investments in Kosovo.

In fact, the Members of the Court of Auditors are chosen from among persons who belong or have belonged to external audit bodies in their respective countries, or who are especially qualified for this office [Footnote 8].
The Court of Auditors shall be informed of the appointment of authorizing officers, financial controllers, accounting officers and administrators of imprest accounts and of the acts of delegation or appointment under Articles 22, 24, 25 and 54.
The Court of Auditors shall be empowered to audit the documents in respect of the revenue and expenditure of the Communities which are held by the departments of the institutions and, in particular, by the departments responsible for decisions in respect of such revenue and expenditure.

In February 2003, the European Court of Auditors organised a selection procedure for the recruitment of auxiliary/temporary typists/clerical assistants of C grade.
According to the Court of Auditors, the complainant was informed that the Selection Board had given him 2 points for his job as a secretary and 3.6 points for the period spent as a typist in a European Institution.
The Court of Auditors thus appears to have informed the complainant of the selection criteria used in the selection procedure and of the detailed marking scale which had led the Selection Board to give him 18.6 points.

The Court of Auditors has refused to sign-off European Community expenditure for the year 2002 (the 9th consecutive year).
For the remaining 90% of the budget, the Court is not able to guarantee that expenditure was legal and regular.

We were required to consider the role of the European Court of Auditors paying particular attention to its capacity to fulfil its functions and efficiently and effectively discharge its responsibilities in the context of the needs of a 25 member Union, or possibly more.
One of the problems facing the Court of Auditors as things stand is that the burden of dealing with the degree of difference will be multiplied enormously by the advent of the new member states.
If one tries to revamp the Court of Auditors so that each member has his or her own division for which he or she is responsible, there simply are not enough credible areas for this to happen.

 The Marta Andreasen and Fabra Valles cases - exclusive report from Dougal Watt Dossier
The fundamental accounting control weaknesses in the European Commission’s SINCOM accounting system, brought to light in April 2002 by Ms Andreasen, the Commission’s Chief Accountant, have been known to the European Court of Auditors for several years.
SINCOM is used by the Court as the basis for selecting its sample of transactions to be examined by the annual “Declaration of Assurance” audit.
Allegations of nepotism by Members of the Court, financial corruption to the benefit of Members of the Court, and systematic mismanagement by Members of the Court, have not been given public consideration by the Committee.

 Court of Auditors sees need for stronger administration in future EU members
The European Court of Auditors has released a special report on 21 May, assessing the effectiveness of PHARE and ISPA aid to the candidate countries.
The Court's audit confirmed the Commission's view that there is still a need for candidate countries to further strengthen their administrative capacities in the environment sector if they are to be able to comply with the EU environmental law.
The Court states that this situation partly reflects the limited scale of funding committed to institution building, despite the particular challenges faced by institutions in this sector, as well as the modest impact of the twinning and technical assistance projects funded by the Commission.

A member of the European Court of Auditors Maarten Engwirda, who is in charge of financial supervision of EU projects in Central and Eastern Europe, visited Slovenia on Thursday, 8 June.
The European court has offered to co-operate with Slovenia, Engwirda said, while Antoncic announced that two auditors of the Slovenian Court of Auditors would leave for a longer training period at the European Court of Auditors, which is seated in Luxembourg.
Antoncic said that the adoption of European standards in financial supervision and state audit, which falls within the competence of the court of auditors, is part of the general framework of the alignment to the EU acquis.

 Institutional corruption: open letter from Whistleblower Watt
Seven months later, coincidentally or otherwise, recommendations for prosecution of a former Member of the Court, and her associates, on allegations of fraud, nepotism, and soliciting bribes in return for jobs, were presented to state prosecutors in Greece and Luxembourg.
And although my allegations against the Court precipitated an internal enquiry by the institution, the results of which I understand have been privately passed to the European Parliament’s Budgetary Control Committee; yet that Committee’s members neither acknowledge my contribution, nor protest the Court’s vindictive pursuit of the “whistleblower” who gave rise to that internal enquiry.
Reliance cannot be placed upon the oversight of the European Parliament, the hierarchy of which has failed to react to evidence of serious wrong-doing in both the Court of Auditors and OLAF.

The official who blew the whistle in April on allegations of corruption and mismanagement at the European Court of Auditors is reported to have been suspended today, Monday.
this year, he complained formally to the European Ombudsman, MEPs and court staff of "systematic corruption and abuse in the European court of auditors." He was subsequently supported by 205 of his colleagues – 40% of the court’s staff – in a secret ballot.
The auditor then fled to Scotland where he was diagnosed as suffering from an anxiety disorder.

 EU Court of Auditors proposes abolishing milk quotas
The Court says that the current level of milk quotas is too high and that European consumers pay too much for milk.
The Court emphasises that the Commission should ensure proper collection of the additional levy charged to milk producers who exceed their quotas.
It says that the reform suggested by the Court that would entail a reduction of the milk quota would also create imbalances in the meat market because an equivalent percentage of cattle would have to be slaughtered.

On 22 April 2002, I “blew the whistle” on systematic corruption and abuse in the European Court of Auditors, in a letter addressed to the European Ombudsman, MEPs, and the staff of the Court.
On 17 June, I separately alleged to the Court that the European Anti-Fraud Office (known by its acronym in French, OLAF) has misled the European Parliament regarding the violent death in suspicious circumstances in 1993 of a Commission official, Dr Antonio Quatraro.
The allegations of corruption, including nepotism, which I presented against the Members of the European Court of Auditors on 22 April and substantiated on 18 June, are serious in nature.
