The European Ombudsman (or sometimes Euro-Ombudsman) is an ombudsman for the European Union.
In accordance with his duties, the Ombudsman shall conduct inquiries for which he finds grounds, either on his own initiative or on the basis of complaints submitted to him direct or through a Member of the European Parliament, except where the alleged facts are or have been the subject of legal proceedings.
The European Parliament shall, after seeking an opinion from the Commission and with the approval of the Council acting by a qualified majority, lay down the regulations and general conditions governing the performance of the Ombudsman's duties.

And the Ombudsman does not seek to remedy a violation of certain predetermined interests (as is the case for the exercise of neutral powers used to prevent violations of rules).
Moreover, as the Ombudsman is not a judge, he is not required to resolve the dispute or assess (with the binding effect of annulment or restitution) the legality of acts or activities of Community institutions.

Article 195 of the EC Treaty empowers the European Ombudsman to receive complaints concerning instances of maladministration in the activities of Community institutions or bodies, with the exception of the Court of Justice and the Court of First Instances acting in their judicial role.
A competence of the European Ombudsman is clearly excluded in so far as Title V (Provisions on a common foreign and security policy) is concerned (see Article 28 TEU), according to which several provisions of the EC Treaty - but not Article 195 - shall apply to this field.

The European Ombudsman is appointed by the European Parliament after each election for the duration of Parliament's term of office.
He is empowered to receive complaints from any citizen of the Union or any natural or legal person residing in a Member State concerning instances of maladministration in the activities of the Community institutions or bodies (with the exception of the Court of Justice and the Court of First Instance).
Where the Ombudsman establishes an instance of maladministration he refers the matter to the institution concerned, conducts an investigation, seeks a solution to redress the problem and, if necessary, submits draft recommendations to which the institution is required to reply in the form of a detailed report.

The basic function of an ombudsman is to investigate and report on complaints against public authorities, just as I suppose the basic function of a doctor is to diagnose and treat physical and psychological complaints.
The Charter was proclaimed at the Nice summit of the European Council in December 2000 and forms Part II of the Constitution Treaty for Europe.
This principle was also applied in 1998 by the European Ombudsman in a case where a European Commission official had contacted without permission a trainee’s doctor in order, as the official put it, to “clarify the situation” as regards a medical certificate issued by the doctor.

During its plenary session of 11 January 2005, the European Parliament voted to re-elect Nikiforos Diamandouros as European Ombudsman with 564 out of a total of 643 votes cast.
