Accession of new Member States to the European Union is governed by Article 49 of the EU Treaty.
The conditions and date of accession, any transition periods required and the adjustments to the Treaties on which the Union is founded must be agreed in the form of an accession treaty between the candidate country and the Member States.
To give due form to the accession, this treaty is ratified by all the Member States and the candidate country in accordance with their own constitutional rules.

The earliest EU treaty was the Treaty of Paris of 1951 (took effect in 1952) which established the European Coal and Steel Community between an original group of six European countries.
If it is ratified, the proposed new Treaty establishing a Constitution for Europe would abolish the three-pillar structure and, with it, the distinction between the European Union and the European Community, bringing all the Community's activities under the auspices of the European Union and transferring the Community's legal personality to the Union.

 How does accession to the European Union work?
In March 1998, the European Union formally launched negotiations on accession with 12 countries, 10 of which joined the EU on 1 May 2005: Estonia, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Hungary, Slovenia, Malta and Cyprus.
In order to assist the countries that have applied to become members of the European Union to carry out the reforms required for membership and to equip themselves to benefit from EU funds on accession, the Union provides financial assistance as part of its Pre-Accession Strategy.
Accession negotiations lasted 8 years in the case of Spain and Portugal, whereas Austria joined the EU six years after filing its application in 1989.

The Treaty of Amsterdam, agreed in 1997 and ratified in 1998, was intended as a sequel to the Maastricht Treaty, with the emphasis on institutional reform to facilitate enlargement and address the EU's 'democratic deficit'.
Given the furore which the Maastricht Treaty caused in 1992 and the extent of the subsequent alterations and additions made at Amsterdam, it is convenient to refer to the original Treaty as Maastricht, leaving the name Treaty on European Union to denote the consolidated and amended version, incorporating the Treaty of Rome.

 Bilateral Investment Treaties with European Union Accession States
We are pleased that on September 2 the European Commission endorsed a political Understanding preserving U.S. bilateral investment treaties with eight countries that are acceding, or are candidates for accession, to the European Union (the Czech Republic, Estonia, Latvia, Lithuania, Poland, the Slovak Republic, Bulgaria and Romania).
The United States supports European Union enlargement and is pleased that we have reached an Understanding that both maintains a positive investment environment in the accession states and furthers the objective of assuring compatibility between the obligations of U.S. bilateral investment treaties and the obligations of membership in the European Union.
Although the European Union, like the United States, has a strong policy favoring the free movement of capital and, thus, potential conflict with the bilateral investment treaties in this area is largely theoretical, we look forward to consulting with the Commission and the other participants on how best to carry this discussion forward.

In the process of enlargement, accession negotiations between the European Commission and applicant country are undertaken to determine conditions under which each country will join the European Union.
The accession of new member states provide an opportunity to revise the Annexes of the Directives and add species that are in need of special conservation measures (to Annex I) or that can be hunted in certain member states (to Annex II).
Most of the accession countries still hold vast areas of extensively managed farmland that is hugely important for birds and other wildlife, therefore the arrival of the CAP could have a devastating effect on them.

Bulgaria and Romania have signed European Union accession treaties, paving the way for them to join the bloc in January 2007.
The treaties contain a safeguard clause delaying entry for a year if either country fails to meet EU standards.
At the signing ceremony on Monday, European Commission President Jose Manuel Barroso said it had been a "demanding and challenging voyage" and the EU set high standards for new members.
