The grounds it was contested on is that the provision providing representation in the legislature for Evangeline was a violation of the State Constitution of 1898, which set the number of representatives for the entire state at one hundred sixteen, and to add one more to that number could be an unconstitutional act.
The amendment concerned the change of boundary lines between the old and new parishes which provided for moving the limits of the new boundary farther north from the Acadia parish line to the center of Bayou des Cannes, in order that Eunice be permitted to remain in St. Landry Parish.
