The Executive Yuan (行政院; literally 'executive court') is the executive branch of the government of the Republic of China.
Its formation, as one of five Yuans of the government, stemmed from the Three Principles of the People, the constitutional theory of Sun Yat-sen, but was adjusted constitutionally over the years to adapt to the situation in Taiwan by changes in the laws and the Constitution of the Republic of China.
Article 58 of the Constitution empowers the Executive Yuan Council to evaluate statutory and budgetary bills and bills concerning martial law, amnesty, declarations of war, conclusion of peace or treaties, and other important affairs before submission to the Legislative Yuan.

In case the Executive Yuan deems an enactment, a budget, or a treaty passed by the Legislative Yuan difficult to enforce, it may, with the approval of the President of the Republic and within ten days after the transmission of the Legislative Yuan's message, request the latter for reconsideration.
The Control Yuan may, according to the work of the Executive Yuan and its Ministries and Commissions, set up a number of committees to look into all aspects of their activities to see whether there is any violation of law or dereliction of duty.
In case of impeachment of the personnel of the Judicial Yuan or of the Examination Yuan for dereliction of duty or violation of law, the provisions of Articles 95, 97, and 98 shall apply.

 Additional Articles of the Constitution
Should the president of the Executive Yuan resign or the office become vacant, the vice president of the Executive Yuan shall temporarily act as the president of the Executive Yuan pending a new appointment by the president.
Should the Executive Yuan deem a statutory, budgetary, or treaty bill passed by the Legislative Yuan difficult to execute, the Executive Yuan may, with the approval of the president of the Republic and within ten days of the bill's submission to the Executive Yuan, request the Legislative Yuan to reconsider the bill.
The proposed budget submitted annually by the Judicial Yuan may not be eliminated or reduced by the Executive Yuan; however, the Executive Yuan may indicate its opinions on the budget and include it in the central government's proposed budgetary bill for submission to the Legislative Yuan for deliberation.

 Legislative Yuan
The amount of control the Legislative Yuan has over the Executive Yuan was unclear throughout the 1990s, but a convention has developed that the Executive Yuan is responsible to the President of the Republic of China and not the Legislative Yuan.
The original members of the Legislative Yuan remained until December 31, 1991, when as part of subsequent Judicial Yuan ruling, they were forced to retire and the members elected in 1989 remained until the 161 members of the Second Legislative Yuan was elected in December 1992.
The Legislative Yuan greatly increased its prominence after the 2000 Presidential elections in Taiwan when the Executive Yuan and presidency was controlled by the Democratic Progressive Party while the Legislative Yuan had a large majority of Kuomintang members.

Taiwan's Council of Grand Justices ruled in January that Taiwan's Executive Yuan should report to the Legislative Yuan before implementing decisions concerning matters of national significance.
Later in January KMT members in the Legislative Yuan banded together with People First Party and New Party representatives to pass a resolution calling upon the Cabinet to continue implementing the budget passed by the legislature in the past and to resume the construction work on the plant immediately.
In spite of continued significant opposition to the plant among the ranks of the DPP, the Executive Yuan opted for national harmony and agreed to the resumption of construction on the plant.

  Taipei -- Taiwan's Council of Grand Justices ruled Monday that the Executive Yuan did not follow due process of law in abolishing the island's fourth nuclear plant, according to Yang Jen-shou, secretary-general of the Judicial Yuan.
  The council ruled after 18 meetings that the Executive Yuan's decision to scrap the partially completed nuclear plant was "a reversal of major national policy" which should have required Premier Chang Chun-hsiung to report to the Legislative Yuan in advance and field questions from lawmakers.
  The ruling also blames the Legislative Yuan for boycotting the premier's attempt to explain his Oct. 27 decision, which, it said, is not an appropriate way of defending the Constitution.

The "pan-blue alliance" is expected to take a three-step approach toward boycotting the referendum: Putting Chen's two questions to a legislative vote; asking the Council of Grand Justices to make a ruling on the constitutionality of the two questions; and mobilizing the heads of counties and townships islandwide to boycott the referendum.
Tseng Yung-chuan, executive director of the KMT's Central Policy Committee, said Saturday that Article 17 of the Referendum Law empowers the president to call a referendum when the nation faces an obvious and immediate threat to its sovereignty.
For his part, Executive Yuan spokesman Lin said Sunday that he sees no chance of the "pan-blue alliance" seeking an amendment to the Referendum Law in an attempt to torpedo Chen's referendum plan.
