Despite action by Congress to create an opportunity for the federal courts to review and correct the violation of Terri Schiavo's most basic rights, the latest effort to prevent her judicially sanctioned murder by starvation appears to be headed for failure.
If, as chief executive of Florida, Jeb Bush believes that starving Terri Schiavo to death is a violation of her right to life, as recognized in the Florida constitution (Article I, Section 2), he has the same obligation to defend constitutional right as he would in the lynching example.
If the legislature and the judiciary agree that the executive is abusing his power, the representatives of the people can charge the executive with the violation of law, impeaching and if necessary removing him from office for his actions, with no imputation of damage to the separation of powers.

Their losses should be at the core of his lawsuit; yet we have to resort to filing a public records request to demand that he put them on the table.

FLEISCHER: The President will soon be issuing an executive order, which is a recognition of a new law that has just gone into effect this year for the first time, that changes the way presidential papers are provided to the public and to historians, to academicians, and of course to the press.
The executive order attempts to give both the sitting president and former presidents the power to prevent the National Archives from releasing documents that the act requires to be made public.
The new Executive Order, signed by President Bush on November 1, 2001, provides that in the absence of "compelling circumstances," the incumbent president will concur in any assertion of executive privilege by a former president who seeks to block public access to presidential materials.

The Order also requires Federal officials to honor executive privilege claims by a former President regardless of the merits of the claim.
