Bailey's clients included the likes of the Samuel Sheppard, the doctor who was accused of murdering his wife, and who became the inspiration for the television series and movie The Fugitive.
Bailey had favorably defended Shapiro in a drunk driving case twelve years prior to the Simpson case.

Bailey's complaints that the referee and the Supreme Court of Florida refused to reopen the record to allow him to submit additional evidence, and his insinuation that the referee was biased against him, do not suffice to demonstrate any defect in the procedural fairness of the Florida proceedings.
Bailey contends that the evidence submitted in the Florida proceedings was insufficient to prove that he misappropriated client funds.[2] The chronology of events underlying the findings of violation is largely undisputed.
Bailey's dispute with the referee's conclusions centers on the inferences to be drawn from those facts, inferences that are ostensibly bolstered by additional evidence later adduced at the trial of his Federal contract claim, and legal arguments concerning whether the facts found amount to a misappropriation of funds.

To provide Bailey with the requisite funds to maintain the properties and to establish a potential pool of money from which Bailey could recover his fees, the prosecutors proposed that one of Duboc's cash accounts (which held approximately $3.5 million) be turned over to Bailey.
To avoid this problem, Bailey and the prosecutors agreed that, instead of the cash account, the Biochem stock would be transferred to Bailey to pay for the upkeep of the mansions and to provide a source from which he could draw fees.
Bailey argues that he could introduce evidence that the stock was not given to him to hold in "formal trust," which he claims would support his argument that he owned the appreciated value of the Biochem stock in fee simple absolute.
