  FindLaw - No. 03-475: Cheney v. U.S. District Court - Brief (Merits)
FACA explicitly envisions only advisory committees "established or utilized by the President" or by an agency, ibid., and it expressly forbids the establishment of an advisory committee "unless such establishment is," inter alia, "specifically authorized by statute or by the President," 5 U.S.C. App.
Accordingly, by its terms, FACA recognizes that the question of whether a group established by the President to give him advice is subject to FACA's requirements is to be determined by the group's formal membership as defined by the President.
Moreover, FACA's focus on the need for the President to establish an advisory committee, as defined by the Act, and its prohibition on unauthorized advisory committees are plainly inconsistent with the concept that such committees can retroactively spring to life by virtue of a post-hoc judicial determination that unauthorized members participated in the group's deliberations.

Legislation & Regulations: Federal Advisory Committee Act (FACA): Key Concepts
In specific terms, FACA applies to committees, boards, commissions, councils, conferences, panels, task forces, or other similar groups "established by" or "utilized by" the federal government If a federal agency creates, manages, or controls such a group, it must be specially chartered and must follow FACA rules.
Some committees are exempt from FACA rules regardless of whether they are established, managed, or controlled by an agency.
While FACA does create obstacles to unfettered influence of advisory groups, some of the criticisms of FACA have been the result of vague and confusing regulations defining the scope of the law.

 FACA Introduction
Congress was concerned that there were too many unregulated advisory groups, that some of those advisory groups were either not contributing anything of substantive value or were duplicating other committees’ efforts, and that the public could not participate in advisory group activities.
FACA was one of several “good government” laws enacted to promote meaningful public participation in government decisions and to ensure that no particular interest groups would have unfair access to policy makers.
Whether or not a group falls under FACA, open public involvement should be a major consideration in the collaborative processes when participating in or designing ADR-based collaborative community working groups.
