FCC backtracks on 2 charges of indecency - Los Angeles Times   (Site not responding. Last check: 2007-09-17)
But this week the FCC said it was deferring to a "plausible characterization" by the network that the incident was a news interview, which merits a higher standard for indecency violations.
Finally, the FCC upheld the main focus of the March ruling: Unscripted profanities uttered during Fox's broadcasts of the "Billboard Music Awards" in 2002 and 2003 were indecent.
In 2003, the FCC's staff concluded that the "F-word" was allowed as an adjective, rejecting complaints about U2 singer Bono's use of the word in that way during the 2003 Golden Globes Awards telecast.

Federal Communications Commission - Wikipedia, the free encyclopedia
The FCC is composed of five Commissioners appointed by the President and confirmed by the Senate for five-year terms, except when filling an unexpired term.
On the issue of broadcast indecency, the FCC has taken heat from right wing conservatives and family-oriented groups for not sufficiently censoring and restricting sexually explicit and violent material to which the groups believe children should not be exposed (a Family Viewing Hour was instituted in the 1970s and then discontinued).
In the actions taken against broadcasters, the FCC is frequently criticized for violating the First Amendment guarantee of Freedom of Speech, both directly by censorship and enforcement action sometimes alleged to be politically motivated, and indirectly by the general intimidation that FCC action allegedly creates, particularly with the U.S. Congress considering multiplying fines exponentially.

 Stations agree on anti-payola settlement - Boston.com
Radio listeners weary of hearing the same songs over and over may have something to cheer about: Broadcasters have tentatively agreed to anti-payola settlements that could shake up music playlists at some of the nation's largest radio chains.
Under the separate agreement, the new "rules of engagement" are aimed at requiring equal access to radio music programmers for all record companies as well as transparency in their dealings, said Peter Gordon, who has been leading the negotiations on behalf of the independents.
Federal law and FCC rules require broadcasters to inform listeners if a station is being paid to play a song.

USATODAY.com - FCC muffles artist's message   (Site not responding. Last check: 2007-09-17)
The FCC is supposed to act within 60 days, but until last week it never issued a final determination, despite continuing appeals to federal courts filed on Jones' behalf by People for the American Way.
While all this was pending, many stations were reluctant to play Jones' song, according to her lawyers, with one San Francisco program director quoted as saying Your Revolution is "a song that's been busted by the FCC." The experimental show on KBOO that played her song in the first place was temporarily canceled.
The FCC said her song was intended to "pander and shock," but in reality it is aimed pointedly at misogynist rappers who, in their words and music, treat women as throwaway sex objects.

The record industry was rocked, however, by the FCC's June decision to fine a Colorado radio station $7,000 for playing an edited version of the same song.
Record industry members and some free speech advocacy groups warn that the FCC is waging an escalating war against free expression, arguing that the best-selling Eminem song had artistic merit, having won a Grammy award.

NM&L (Spring 2001): FCC defines the indefinable: Indecency
Whether the release of the guidelines is a precursor to a crackdown on indecency or simply making good on a long-standing promise is yet to be seen, but it is a major development for an agency that for the last seven years has said very little on the subject of indecency.
One FCC regulation that has survived this test is the rule allowing restriction of indecent speech outside of a "safe harbor" time period, which the U.S. Court of Appeals in Washington, D.C., finally approved in 1995 after much wrangling.
The guidelines outline some of the issues the FCC looks for in an indecency complaint, such as: the explicitness or graphic nature of the material; whether the material dwells on or repeats at length the indecent content; and whether the material apparently is presented for pandering or titillating purposes or for shock value.

Martin said that the FCC’s Enforcement Bureau had been directed to review the settlement agreement reached by Sony BMG and Spitzer, and investigate any incidents in which the agreement discloses evidence of payola rule violations.
The bill would simultaneously strengthen the FCC’s ability to prove and punish violations, clearly prohibit indirect payola, prevent cross-ownership from hindering fair competition, and increase transparency through disclosure of payments to radio stations from artists, labels, promoters and others who may have an interest in improperly influencing airplay decisions.
The legislation would give people confidence that the songs they hear on the radio are played because of perceived merit, and not because the station cut a backdoor deal for financial gain.

The Blog | Jonathan Rintels: FCC Report Says Media Consolidation Harms News Coverage - FCC Then Orders Report Destroyed ...
The conclusion is at odds with FCC arguments made when it voted in 2003 to increase the number of television stations a company could own in a single market.
At that time the report was written, the FCC was publicly proclaiming the evidence showed that "commonly owned television stations are more likely to carry local news than other stations" - a conclusion refuted by the FCC's own research, which it then destroyed.
This is a body blow to the FCC and its renewed drive, under Martin, to try again to loosen those crucial ownership limits that promote local news coverage.

Under the law, regulatory agencies such as the FCC have a majority and minority status, depending on which president is in power.
The FCC took care of that problem by enacting far greater fines than ever in history so all stations which carry filth can be penalized.
