FERC Commissioner Nora Brownell indicated during the public meeting hours earlier that she would likely not support California's argument that the contracts be voided because it would scare away investors or discourage companies from signing similar deals in the future.
But, in what appears to be a violation of FERC's own federal rules, Brownell told the Wall Street analysts on the conference call after the meeting exactly how she and Wood would vote on the issue when it comes up for a vote at a FERC meeting in mid-April.
On the other hand, FERC doesn't want to scare away more investment from the electricity industry, which is still in desperate need of new electric transmission lines and will need more power plants soon in some regions of the country.

While FERC is not the only agency to take steps to remove or restrict information in the wake of last year’s terrorist attacks, this rule would be the first permanent action by a government agency.
FERC utilizes several justifications to make its case that the agency is not altering or ignoring its responsibilities under FOIA.
FERC explained that while companies are legally required to cooperate with and submit information to FERC, if CEII were disclosed by the Commission companies would not be as trusting of the Commission and less forthcoming in the more subjective portions of their submissions.

When FERC was established in 1977 as a replacement for the Federal Power Commission, its mandate was to determine whether wholesale electricity prices were unjust and unreasonable and, if so, to regulate pricing and order refunds for overcharges to ratepayers.
With a modest $175 million budget and 1,200 employees, FERC is responsible for overseeing a $250 billion electricity industry, which puts the agency in charge of regulating pricing for about 73 percent of the electricity used in the United States.
FERC's five-member governing board is selected by the president and consists of five commissioners, all of whom serve staggered five-year terms.

FERC can no longer ignore the evidence-it is time for FERC to revoke Enron's market-based rate authority as of January 1, 2000.

Opponents of language proposed by myself and Senator Cantwell to increase FERC's authority under the Federal Power Act to prevent this type of manipulation from occurring have always argued that FERC has sufficient authority to prohibit fraud and manipulation of market-based power and transmission transactions.
FERC's inaction is deeply troubling to me in light of all the transcripts that have been released.
