The Free Software Foundation of Europe (FSFE) has filed a petition to be admitted as a plaintiff in the EU Commission's antitrust proceedings against Microsoft.
FSFE President Georg Greve explained that his organization's participation is all the more important for freedom and interoperability as Microsoft increasingly succeeds in paying off its opponents.
Greve claims that the FSFE discovered last week that Microsoft was manipulating the "Vienna Conclusions" for the World Summit on the Information Society in Tunis.

 FSFE plans to intervene in Microsofts EC antitrust sanctions appeal - Computer Business Review
FSFE is already involved in the main EC antitrust case against Microsoft, which saw the company hit with a record 497.2m euro ($613m) fine and other remedies in March 2004.
As well as appealing the remedies in general, Microsoft in September launched an appeal against the interoperability sanction in particular, in an attempt to expedite a decision on whether it will be forced to share communications source code with open source software vendors.
FSFE's lawyer, Carlo Piana, told Computer Business Review that if its leave to intervene is granted then the free software group would once again assist the EC in providing industry and open source-specific information, but denied that the EC's case is weakened by a lack of high-profile vendor supporters.

November 25, 2005 (IDG News Service) The Free Software Foundation Europe (FSFE) has asked to be allowed to make arguments against Microsoft Corp. in part of its appeal against last year's antitrust ruling against it by the European Union's competition authority, the European Commission, an FSFE attorney said Thursday.
The FSFE and Samba counter that without the right to develop products that can interoperate with Microsoft's server software, Samba's software would not be able to compete with Microsoft's products, something the commission hopes to ensure.
If the request to intervene is accepted, the two parties would be able to make written submissions to the court, view submissions from Microsoft and the commission (except those deemed confidential by the court), and take part in oral court hearings.

Greve said that despite the importance of the antitrust case in establishing the bounds of acceptable behaviour in the IT industry, the FSFE has been one of the few organisations that has helped the Commission.
"[The] FSFE has been working on this case for many years, from the original investigation, over the 2004 decision, to the European Court case where it is now one of two remaining third parties on the side of the European Commission," wrote Greve, in his blog.
A FSFE spokesman said on Thursday that there are, in fact, four third parties supporting the European Commission in the court case — the FSFE, the European Committee for Interoperable Systems (ECIS), VideoBanner, and the Software and Information Industry Association, but added that the latter two have "given very limited contributions".

In June, the Commission began market-testing the proposal with industry groups such as the FSFE (Free Software Foundation Europe) and the Samba interoperability project.
