Notice of meetings of subgroups of the NCD advisory committees, including, but not limited to, subcommittees, in which the members thereof do not engage in ultimate decision-making relative to advisory committee recommendations to the National Council on Disability, is not required and public attendance and participation is not mandatory.

Whether FACA serves the goal of ensuring that the government has an open and accountable process for using advisory committees, such consultations are public, and advisory committees include a wide range of views.
FACA applies to any advisory group that is "established" or "utilized" by a federal agency and that has at least one member who is not a federal employee.
The Privacy Act permits individuals to waive such protections and, given the importance of achieving balance on such committees, it is reasonable for an agency to require candidates to execute such waivers as a condition of serving on a committee.

The Act requires standing committees of the Senate and the House of Representatives continually to review the activities of advisory committees under their jurisdiction to determine whether they should be abolished or merged, whether their responsibilities should be revised and whether they perform a necessary function.
Advisory committees can be established only if specifically authorized by statute or by the President, or if determined by an agency head to be in the public interest in connection with the agency's legal duties.
Advisory committee meetings must be open to the public with public notice provided; interested persons must be permitted to appear before the committee; detailed minutes must be kept of meetings; and committee reports, minutes, transcripts, studies and other documents must be available for public inspection and copying.

 Federal Advisory Committee on Geologic Mapping — NCGMP
The National Geologic Mapping Act of 1992 and its reauthorizations in 1997 and 1999 (and anticipated in 2006) mandate that the NCGMP establish a geologic mapping advisory committee to advise the Director of the USGS on planning and implementation of the geologic mapping program.
The NCGMP Federal Advisory Committee must have an official charter that explains the official designation, authority, function, membership, ethic responsibility, official to whom the committee reports, duties of the committee, committee support, number and frequency of meetings, travel expenses for representatives, estimated annual operating expenses, and rules for continuation and termination of the committee.
The NCGMP Federal Advisory Committee must submit an annual report to the Secretary of the Department of the Interior that evaluates the progress of the Federal, State, and university mapping activities and the progress toward fulfilling the purposes of the NCGMP, the Federal Advisory Committee, the NCGMP five-year plan, and the National Geologic Map Database.

In specific terms, FACA applies to committees, boards, commissions, councils, conferences, panels, task forces, or other similar groups "established by" or "utilized by" the federal government If a federal agency creates, manages, or controls such a group, it must be specially chartered and must follow FACA rules.
For example, the Federal Land Policy and Management Act (FLPMA) requires the Secretary of the Interior to create FACA advisory committees, called Resource Advisory Committees (RACs), to advise her and the Bureau of Land Management (BLM) on public land management issues.
The committee also has to be set up to assure that the advice and recommendations that it gives are not inappropriately influenced by either the agency or by any special interest.
