The administration of FIFRA was given to the newly created EPA, and the District of Columbia Circuit Court of Appeals held that the Administrator had a duty to suspend a registration when a substantial question of an "imminent hazard" existed.
FIFRA guarantees the registrant of a pesticide a full-blown adjudicatory hearing before cancellation, which may take place whenever it appears that "a pesticide or its labeling or other material required to be submitted does not comply with.
FIFRA therefore does not oblige the Administrator to maintain the registration of a pesticide that might not generally have adverse effects but, say, killed children on 30% of the occasions on which it was used.

The Act directs EPA to restrict the use of pesticides as necessary to prevent unreasonable adverse effects on people and the environment, taking into account the costs and benefits of various pesticide uses.
FIFRA prohibits sale of any pesticide in the United States unless it is registered and labeled indicating approved uses and restrictions.
Although federal pesticide legislation was first enacted in 1910, it aimed to reduce economic exploitation of farmers by manufacturers and distributors of adulterated or ineffective pesticides.

In weighing any regulatory action concerning a public health pesticide under this Act, the Administrator shall weigh any risks of the pesticide against the health risks such as diseases transmitted by the vector to be controlled by the pesticide.

The Agency may decide to require an EUP to ensure that the experiment is conducted within certain defined limitations, the necessary data are developed to assess the proposal, or certain kinds of data are developed during the test and reported to the Agency.
Under FIFRA, the Agency would therefore be notified before initiation of small-scale field testing of the microbial pesticide in the continental U.S. In normal usage, nonindigenous organisms are generally considered to be naturally occurring organisms placed in environments where they are not native or have not evolved.

The Act also requires that pesticides be labeled in an approved manner and makes it unlawful for anyone to use the pesticide in a manner inconsistent with its labeling.
These records must be made available, upon request, to federal or state agencies dealing with pesticide use or a health or environmental issue related to the use of pesticides, as well as to health professionals needing the information in order to provide treatment or first aid to a person exposed to the pesticide.
The Act authorizes the Administrator to make indemnity payments to persons who own any quantity of a pesticide immediately before the Administrator issues a notice of intent to suspend, if the registration is suspended and later canceled and the person suffers losses by reason of the suspension or cancellation.

The Fair Labor Standards Act of 1938 (FLSA), specifically bans "oppressive child labor." According to FLSA, "oppressive child labor" is the employment of a minor in an occupation for which he or she does not meet the minimum age standards of the Act.
Some of the State restrictions are the same as the Federal laws, some restrict daily or weekly hours (or both) for minors under the age of 18 in agricultural employment, and some have specifically adopted standards for agriculture that are more stringent than those of the Federal government (U.S. Department of Labor, 2000).
In 1972, the Federal Environmental Pesticide Control Act was enacted, which required the Administrator of the Environmental Protection Agency (EPA) to ensure that the labeling and classification of pesticides protected farmers, farmworkers, and other persons coming in contact with pesticides or pesticide residues.

An example of this would be that loss of insecticides effective at low rates of application may lead to more frequent use of other insecticides or use at higher rates, causing the potential for greater worker exposure and adverse environmental consequences such as runoff into surface waters or air pollution.
Under the new act, the requirement for tolerances for emergency exemptions under Section 18 of FIFRA could also be significant for California.

On March 12, 2001, this court reversed the lower court's ruling and found that "the registration and labeling of Magnacide H under the Federal Insecticide, Fungicide, Rodenticide Act (FIFRA) does not preclude the need for a permit under the CWA." The Talent decision was not appealed to the Supreme Court.
FIFRA establishes a national uniform labeling system to regulate pesticide use, but does not establish a system for granting permits for individual herbicide applications.

According to government records obtained by NRDC through a Freedom of Information Act lawsuit, EPA officials met secretly more than 40 times with representatives from atrazine's main manufacturer, Syngenta, while the agency was evaluating the weed-killer's toxicity.
In addition, if the agency establishes a group of outside advisors, the Federal Advisory Committee Act requires it to create a balanced advisory committee that meets in the open and is not "inappropriately influenced" by "any special interest." Today's suit charges that EPA has ignored these requirements in its atrazine and DDVP negotiations.
The lawsuit was filed today in federal court in Washington, D.C. NRDC is represented in the case by Colangelo, Olson, and the public interest law firm Meyer and Glitzenstein.
