Switzerland has no unified civil procedure law and no uniform court system, and the designation of the courts, rules of procedure and conditions for appeals vary considerably.
Switzerland has established a system of legal aid that is governed (in accordance with Article 42 of the Hague Convention) by cantonal law, although a minimal standard and guidelines are set by the case law of the Federal Court.
Pursuant to this case law, an applicant is entitled to legal aid if he or she is indigent (unable to pay a living for him/herself and his/her family in addition to the legal fees) and if the chances of winning the case are greater than the chances of losing it.

 Parallel Imports in Switzerland
Since, in Switzerland, neither the Copyright Act, the Trademark Act, nor the Patent Act determined whether parallel imports of goods protected by intellectual property were allowed or prohibited, the Federal Supreme Court stepped in and decided this question by issuing three opinions relating to trademark, copyright, and patent law.
In reaching its decision, the Court explicitly stated that the principle of international exhaustion could not be defeated by contractually limiting the distribution right of a foreign distributor to certain territories excluding Switzerland, because these limitations are of a contractual nature and cannot be invoked against third parties.
As a result, the Federal Supreme Court had to fill this gap by putting itself in the position of the legislature (in accordance with the methodology called for by Section 1 of the Civil Code).

Switzerland had previously been involved as party to the Statute of the International Court of Justice and member of most UN specialized agencies, as well as the International Atomic Energy Agency.
Traditionally, Switzerland has avoided alliances that might entail military, political, or direct economic action, but in recent years the Swiss have broadened the scope of activities in which they feel able to participate without compromising their neutrality.

In April 2003, the Federal Tribunal ruled that it was constitutional to refuse a license to run a private school to a body affiliated with the Church of Scientology because of the latter's controversial nature, a stance the court had already taken in 1993 and 1996.
According to the Federal Statistics Office, 24 persons were convicted in 2002 under the 1995 anti-racism law (down from 38 convictions in 2001), whereas 3 persons were sentenced for interfering with religious freedom or freedom to worship (down from 4 convictions in 2001).
In July 2000, the Federal Tribunal ruled that a unilateral repudiation by a Muslim man against his wife could not be recognized because it contravened the country's values of justice and the basic rights of a defendant to appeal.

Introducing the report, Patricia Schultz, Director of Switzerland’s Federal Office for Equality between Women and Men, explained the three-level structure of Switzerland’s Government, consisting of the Federation, the cantons and the communes.  The 26 cantons had their own political and judicial organizations and applied their own law as well as federal law, maintaining substantial powers.
FUMIKO SAIGA, expert from Japan, noted that it had taken Switzerland a long time to ratify the Convention.  She asked what the relationships of the Cantons were with the federal offices and commissions for gender equality.
