A federal district court in New Jersey has ruled that a school district’s use of a survey of students that included questions on sensitive subjects did not violate students’ free speech or privacy rights or parents’ rights to make decisions regarding the care and control of their children.
The U.S. Court of Appeals for the Third Circuit upheld the dismissal of the Fifth Amendment self-incrimination claim, but it reversed the district court on all of the other claims and remanded the case back to the district court for further discovery on certain factual matters.
The court then addressed the claim concerning parents’ rights, concluding that the nature of the survey and the parental notice negated any possible inference of school-sponsored interference with parents’ fundamental right to care for and control their children.

The Hamdan case is the case that was considered by the Circuit Court of Appeals for the District of Columbia that held that the President had the authority to conduct military commissions.
I would defer to the Justice Department -- I suspect the Circuit Court of Appeals will, in deference to the Supreme Court, withhold issuance of the mandate in that case, until the Supreme Court rules on the application for writ of certiorari.
And as far as their access to the Federal District Court, of course, there's already a case pending dealing with them right now.
