In fetal protection policy cases, the employer often argues that because the workplace toxin is a teratogen or transplacental carcinogen, it could cause fetal deformities in pregnant women employees.
Fetal protection plans are another scheme in a pattern of policies which, over the last century, have limited women's opportunities in the workforce.
He stated that before the fetal protection policy went into effect six female employees were pregnant at the same time they were exposed to "high lead" levels, and one of them gave birth to a child who subsequently became hyperactive, which the consultant claimed was probably caused by the mother's prior exposure to lead.

Fetal protection is defined as “the ability to prevent transplacental transmission of BVDV and subsequent fetal infection in pregnant cattle”.
Fetal protection is determined generally by experimental infection of vaccinated pregnant animals at 75 days of gestation.

The Fetal Protection ...   (Site not responding. Last check: 2007-10-11)
Fetal protection policies, which were adopted by many private sector employers in the 1980s and early 1990s, raised difficult questions about gender equality, employer responsibilities for occupational safety and health, and fetal rights.
The disparate treatment framework is much more protective of employee rights, and requires that employers prove that their facially discriminatory practice or policy is justified as a bona fide occupational qualification, that is, that the practice or policy be based on some qualification that is closely related to job skills or aptitudes.
Fetal protection policies barred women because of their 'differentness,' that is, because they can become pregnant and carry a fetus.

She may be held in custody as long as necessary to protect the unborn child in the home of an adult relative or friend, a private or public residential substance abuse treatment facility, or a hospital (48.207).
Alternatively, the court can release the woman, order counseling or some other form of outpatient supervision (48.347[1-6]), "impose reasonable restrictions" on her travel, restrict "association with other persons or places of abode," or conduct "which may be necessary to ensure the safety of the unborn child and of the child when born" (48.213).
Perhaps the fetal protection focus on women is the result of a culture that still views childbearing and childrearing as largely female responsibilities.

A woman of childbearing age is denied employment in a plant that uses chemicals which could cause damage to a fetus if she were to become pregnant.
Efforts such as these to protect the unborn frequently have the side effect of eroding the rights of women, says Harvard University law professor Martha A. Field in Emerging Issues in Biomedical Policy, an annual review.
Although higher courts have overturned many of these actions, new efforts are emerging, aimed at forcing women to do what a doctor or society believes to be best for her child.

Bork ruled the fetal protection policy wasn't hazardous because the women had the option of surgical sterilization.

In such circumstances, the fetus is viable, and, if it is likely to die without the recommended medical intervention, the state's responsibility to the fetus may outweigh the mother's right to decide what should be done to her body.
As recognized in one of the cases mentioned earlier, employer liability to offspring is a major, if not the major factor, underlying occupational fetal protection policies.22 A number of states have allowed recovery for injuries inflicted on fetuses by third parties.
Now that fetal protection policies have been held to violate the Act, it is time to look at other ways of dealing with the acknowledged, and unacknowledged, workplace hazards for fetuses.

Three Arkansas men who allegedly kicked a pregnant woman in the stomach, killing her nine-month fetus, are the first to be charged with first-degree battery and capital murder under the state's new Fetal Protection Law, the AP/Washington Times reports.
Erik Bullock was also arrested and charged with murder Thursday for allegedly hiring the three brothers to pose as masked intruders and beat his girlfriend to cause the death of her fetus.
The murder charges mark the first test of the new law, and prosecutors said Thursday that it was enacted "just in the nick of time." Last spring, the state Legislature made injuring a fetus more than 12 weeks old a criminal offense, but allows exceptions for abortions.

Worldandnation: House okays fetal protection bill
Its supporters called it an anti-violence measure designed to ensure that criminals who attack a pregnant woman are charged with murder or manslaughter if the woman survives but her "unborn child" perishes.
While the bill says specifically that it does not apply to abortion, opponents said the legislation was a thinly disguised effort to undermine abortion rights by granting a new legal protection to a fetus.
The bill passed 252-172, almost the same vote as last session, when it died in the Senate in the face of a veto threat by President Clinton.

It's a public health issue, and as such, providing sanitary and antiseptic conditions to perform a procedure that, quite frankly, only religion has a ferreous position on, would greatly improve the situation for a lot of women.
Example: If a man rapes his own daughter (sad, but it does happen), the way you put our system it would be allowed since he holds her rights anyway.
And to abortion naysayers, I would say that in countries where abortions are legal, it isn't the most popular form of contraception and they don't have ten abortions a year.

Oaks looks at the emphasis public health educators place on individual responsibility, current legal and social assertion of fetal personhood, changing expectations of pregnant and prepregnant women, and the advent of antismoking campaigns.
She explores how public health educators discuss "the problem" among themselves, how they communicate with pregnant smokers, and how these women in turn understand the "risk" of fetal harm.
Without downplaying the seriousness of the health risks that smoking poses to women and their babies, this book supports new efforts that challenge the moral policing of pregnant smokers.
