Slyck News - Filesharing: The Facts and the Myths
In a civil case (such as filesharing) the burden of proof is much lower, the plaintiffs (the civil equivalent of the prosecution) merely having to prove that, on the balance of probabilities, you did what they actually claim.
Mrs Chan was taken to court by the RIAA on the basis that her computer was used for filesharing by her juvenile daughter.
Dawnell Leadbetter: In this case the Defendant also denies that she was the one filesharing, and is counterclaiming against Comcast.

AlterNet: Filesharing Is Not the Enemy
Still, the episode's underlying message -- that filesharing is stopping CD sales and destroying the recording industry -- has been promoted by groups like the Recording Industry Association of America (RIAA) ever since Napster hit the mainstream five years ago.
With only four companies controlling mainstream music, the common belief is that filesharing brings democracy to the music industry by allowing people to have access to music they would never otherwise see.
The problem is that some see filesharing as a way of ripping artists off and some see it as a technology that, if harnessed correctly, could cut out the middleman and benefit the artists even more.

It worries me that people see filesharing as illegal, and spout garbage about what people might or might not be sharing.

A recent analysis of the latest P2P trends in Germany shows that BitTorrent is now the most popular filesharing protocol in the country, leaving eDonkey behind for the first time.
This growth can be called explosive because more than 50% of the German filesharers now use BitTorrent, in 2005 this was only 1 in 5.

We’ll have a lot more to say about that story as it develops, but we also wanted to discuss a new academic study that was released this week, which concludes that filesharing does not impact CD sales (it’s been getting a lot of attention).
But realisitically, this seems like a minority of filesharers, and with the rise of iPods and other mp3s players that don’t tie the user to a computer, interest in owning physical CDs is likely to drop considerably.
And the study rightly points out that the primary effect of filesharing is to greatly increase consumption of music and there is no disputing the fact that the overwhelming majority of downloads are not substitutes for CD purchases.

Even if filesharing is illegal this apparently applies in the most of the scandinavian countries.
Of coz if this flies, then you could in theory insure yourself against a murder coinviction, you'd still have to spent time in jail, but the added compensation for the victims relatives would still be payed by the insurance company.

Freedom to Tinker » Blog Archive » The Future of Filesharing   (Site not responding. Last check: 2007-10-11)
From a technology standpoint, the future of filesharing will involve co-evolution between filesharing technology on one side, and anti-copying and anti-filesharing technology on the other.
First, the filesharing side can probably adapt faster than the anti-filesharing side; and speed is important in this kind of move-countermove game.
Second, the defensive technologies that filesharing systems are likely to adapt are the same defensive technologies used in ordinary commercial distributed systems (end-to-end encryption, anti-denial of service tactics, reputation systems, etc.), so the filesharing side can benefit from the enormous existing R&D efforts on defensive technologies.

Most filesharing networks are used for moving large amounts of content that people can't legally have without a purchased copy.
Getting caught receiving or distributing copyright protected content by its owner could mean a lawsuit, and would definitely not go over well with your dean or your department.
Although no one at Columbia is monitoring the content of what is uploaded and downloaded through its network, it's very easy for copyright owners and their agents to join the filesharing network and collect that information themselves.
