The Fishman Affidavit is a set of court documents submitted by ex-Scientologist Steven Fishman in 1994 containing criticisms of the Church of Scientology and, controversially, substantial portions of the Operating Thetan course materials.
The documents were brought as exhibits attached to a declaration by Steven Fishman on 9 April 1993 as part of Church of Scientology International v.
Fishman told the court that he had committed crimes on behalf of the Church.

Where would Steven Fishman have acquired $400,000, and if he did acquire it, why would there be almost three years between the event date and date of entry on the docket?
The only documents available (and linked from the docket) at present are the Government's Motion to Dismiss With Prejudice (on a variety of rather dull procedural grounds) as well as an (equally dull) attachment to that same motion.

In 1995, the Church of Scientology had started its war against the internet.
Spaink was one of the first famous Dutch people to use the internet and was one of about hundred Dutch people to put up pages containing the Fishman Affidavit[?] in protest against the actions of the church.

Lerma uploaded the so-called "Fishman Affidavit" after consulting a lawyer and in the honestly mistaken belief that, as a public court document, it was not covered by the copyright law.
Attached to the affidavit were a number of Scientology documents, including short portions of two documents entitled "OT II" and "OT III." Lerma asked Harshman about posting the Fishman Affidavit and was told that the posting would be lawful.
He certainly removed the Fishman affidavit: what was left were scraps of documents almost impossible to identify.

Scientology sued some 15 providers, and one individual: me. Scientology had refused to prove their claimed copyrights until only a week before the court session; once a notary had stated on Feb. 18 that OT 2, OT 3 and 'Ability' (i.e.
Exhibit G) were indeed copyrighted by Scientology, I immediately changed these parts of the Fishman Affidavit and put up an adapted version, making fair use of quotes from the originals.
The judge considers the parts from the OT's that were used in the Fishman Affidavit to have been legally made public, precisely because they were part from an open court file; hence, they can not be regarded as unpublished material, as Scientology has always claimed.

I had not previously related this information to 3 anyone prior to the signing of my preliminary affidavit on 4 this issue in September, 1993, as I did not recall that 5 Judge Swearinger was the trial judge in the case of 6 Wollersheim v.
