In law, matter in pais is matter of fact in opposition to matter of record: a trial per pais, is a trial by the country, that is, by a jury.
A discharge under the insolvent laws does not protect the property of the insolvent, and he may in general be sued on his contracts, though he is not liable to be arrested for a debt which was due and not contingent at the date.
Although the general rule of law is, that no one is liable upon any contract except such as are privy to it; yet this is not contravened by the liability of partners, as they are imagined virtually present at and sanctioning the proceedings they singly enter.

While that statement -- many law students go to work at large law firms -- has been true for decades, the firms to which those students are going have changed substantially, in terms of size, scale of activities, mobility of both partners and associates, and demands on lawyers' time.
Law practice has changed, with firms ever more focused on the "bottom line." Students and new associates, burdened by massive debts, are also attentive to the economics of practicing law; a prime consideration for both partners and new associates is how to make the most money in the least amount of time.
Law students today may see themselves as individuals without much ability to alter the firms where they will practice, just as senior partners may have a parallel sense of inability to affect change in the law schools that supply their work force.

Powelson Chapter 6 - Law as an Institution of Economic Growth
Under the centralization of law by Henry I (r.1100-1135) and his grandson Henry II (r.1154-1189), "the royal government sought to exercise a general supervision over the workings of the local courts [which] remained community courts." [12] The law itself was composed by local officials responsible to the king.
The ruler's law was an antagonist, against which the private person defended himself: "[F]riendships formed a bulwark against 'the law,' which insinuated itself wherever it could, manifesting its power when successful through a symbolism of penetration." [19] This is still the law of the powerful, not yet yielding to a balance of forces.
First, laws on trade and economics were forged by the participants — guilds, towns, merchants, and craftsmen — with the cooperation of the lord of the manor or the king and his bureaucracy.

Hours after filing a federal lawsuit against the law's "secret censorship orders," aimed at Internet and backbone providers, two civil liberties groups won a dramatic concession from the Pennsylvania attorney general, who agreed to cease using the orders until the case is heard in November.
When the law was used to force WorldCom (now known as MCI) to ban access to some sites with suspected child pornography, the company said it had to block the sites for all of its North American subscribers.
The Pennsylvania state law in question, which took effect last year, permits the attorney general to order ISPs to block access to the Internet Protocol address of sites that are suspected of featuring child pornography.

Yet the law, in effect, lumps together in the same category victims of terrorists with the terrorists themselves.
The definition is so vague that it applies to someone who almost half a century ago was a member of a guerrilla movement that received assistance from the U.S. government.
It proposed that the secretary of state determine which groups are and which are not terrorist so that our allies not be punished by the law, and that the exception be made for those persons who are not a threat to U.S. national security.

An 1882 federal law limited U.S. citizenship "to aliens being free white persons and to aliens of African nativity and to persons of African descent".

Likewise, the law considers legitimate the desire to see men cast in male theatrical roles and women in female roles;119 again, it does not insist that we get used to men playing women and vice versa (though such an attitude would not be unprecedented).
The basic principle of antidiscrimination law is that this sort of coexistence is furthered by nondiscrimination, not by accommodation of discriminatory impulses.
Perhaps the law's deterrent effect should be strengthened by providing for generous punitive damages; perhaps punitive damages are a mistake and should be scrapped or limited.
