Fordyce, Arkansas: Quick Facts   (Site not responding. Last check: 2007-10-10)
Fordyce began as a dream of Civil War Colonel Samuel Fordyce, the same Colonel Fordyce who was a major builder and developer in the railroad industry during the late 1800s and early 1900s and built the Fordyce Bath House in Hot Springs.
The railroad, whose corporate name is now "Union Pacific", originated in Texas in 1877, and arrived in Dallas County in 1882.
Fordyce is the only town in the nation to have the "Redbug" as their mascot.

Fordyce, who was injured while serving in the Union Army during the Civil War, moved to Hot Springs in 1873 to partake of the "healing waters" of the resort city.
Although the city of Fordyce didn't exist during the Civil War, there were settlers in the region who had already established such towns as Tulip and Princeton.

Thus, they are entitled to little weight where, as here, the railroad's actions demonstrate an intent not to abandon by its continued willingness to negotiate and its statement that it has indeed conveyed the line to CKC for interim trail use.
A railroad presumably would not agree to negotiate with a prospective trail sponsor unless that railroad believes the trail sponsor will be able to manage the right-of-way and assume legal liability and pay taxes.
However, the railroad already has the ability to protect itself from that result merely by refusing to consent to the issuance of the trail condition.

When acquiring railroads in our existing regions, we target contiguous or nearby rail properties where our local management teams are best able to identify opportunities to reduce operating costs and increase equipment utilization.
In furtherance of that goal, Class I railroads focused their management and capital resources on their long-haul core systems, and some of them sold branch lines to smaller and more cost-efficient rail operators willing to commit the resources necessary to meet the needs of the shippers located on these lines.
Comprehensive provisions are set forth in the RLA establishing the right of railroad employees to organize and bargain collectively along craft or class lines and imposing a duty upon carriers and their employees to exert every reasonable effort to make and maintain collective bargaining agreements.
