In proprietary software, the copyright is usually held by the employing entity, not by the individual software developers.
Forks are considered an expression of the freedom made available by free software and a weakness since they duplicate development efforts or can confuse users over which forked package to use.
OpenSSH was a fork from SSH, which happened because the license for SSH 2.x was non-free (even though the source was available), so an older version of SSH 1.x, the last to have been licensed as free software, was forked.

Software people speak of "families" of applications and "product lines" and "family-specific architectures." Those are the people who are realistic enough to believe that reuse-in-the-large, if it is ever to succeed, must be done in a collection of programs that attacks the same kinds of problems.
Typically, a software system is built to a certain design envelope (the framework that enables but at the same time bounds the chosen solution) and with a design philosophy (different people will often choose very different approaches to building the same software solution).
To make matters worse, during maintenance itself, as the software is modified (and modification is the dominant activity of the software field, as we see in Fact 42), whatever maintenance documentation exists is probably not modified to match.

 Context of the STWW research project
Although the economic relevance of software evolution is clear, the importance of software evolution is still underestimated by the software engineering community, as can be inferred from the fact that state-of-the-art object-oriented software engineering methodologies do not properly address software evolution issues [GR95].
Poor effort estimation: when a software system needs to evolve according to new or changed specifications, software engineers like to assess the number of classes and dependencies between classes that need to be changed in order to meet the specifications.
Within the framework of software engineering several Ph.D. research projects are put in place: reuse on the analysis level, iteration between successive phases in the software development cycle, the semantics of object-oriented modeling, reverse end re-engineering, etc.

These, I think, were the most important to his argument for the open source approach to building software, because they all either describe a rule for maintaining a project, describe a benefit of the open source approach, or describe a software engineering rule which the open source approach makes easier to follow.
This is a very good point, and one very central to software engineering, but this applies just as well to the closed source approach as to the open source approach, and open source approach is no more conducive to this method than is the closed source approach.
He makes several good points about why software should be a service industry; I was particularly impressed by the fact that only 5% of programmers actually work on software which is meant to be sold.
