Amendment XIV (the Fourteenth Amendment) of the United States Constitution is one of the post-Civil War amendments and includes the due process and equal protection clauses.
The Supreme Court limited the reach of the Amendment, however, by holding in the Slaughterhouse Cases that the "privileges and immunities" clause did not create any new federal rights, then holding in the Civil Rights Cases that the Amendment did not authorize Congress to outlaw racial discrimination on the part of private individuals or organizations.
Thus, on July 28, Seward was able to certify unconditionally that the amendment was part of the constitution without having to endorse Congress's assertion that the withdrawals were ineffective.

In 1798, the armies of the French Revolution conquered Switzerland and imposed a new unified constitution.
As a consequence of the civil war, Switzerland adopted the use of referenda and a federal constitution in 1848, amending the latter extensively in 1874 and establishing federal responsibility for defence, trade, and legal matters.
Although the constitution provides that the Assembly elects and supervises the members of the Council, the latter (and its administration) has gradually assumed a pre-eminent role in directing the legislative process as well as executing federal laws.

As I understand the Constitution, a person who has retired from Government - I presume it is always on a matter of principle - is not prevented from saying, "I retired from Government because I did not agree with a decision of the Government on a very important matter".
I argued the point strongly with members of a former Government when discussing amendments that if detail such as the words "save in accordance with what may be decided by law" were inserted in the Constitution, we would invite the type of trouble we wished to avoid.
Amendment No. 1 must be accepted by the Government and by the Fine Gael Party to improve the constitutional amendment, to maintain its tightness and focus and to give the protections which we all recognise must be given.

Indeed, the debates over the Constitution constantly referred to the organized militia units as a threat to freedom comparable to that of a standing army, and stressed that such organized units did not constitute, and indeed were philosophically opposed to, the concept of a militia.
