The Fundamental Orders were adopted by the Connecticut council on January 14, 1639.
In one sense, the Fundamental Orders were replaced by a Royal Charter in 1662.
Today, the individual rights in the Orders, with others added over the years, are still included as a Declaration of Rights in the first article of the current Connecticut Constitution adopted in 1965.

For two years before the adoption of the Fundamental Orders by the Connecticut General Court on January 14, 1638/39, the three river towns cooperated under a simple form of government that was composed of magistrates and representatives from each town, but the towns had no formal instrument of government.
No religious test was established for voting, the Orders omitted all reference to the authority of the crown, and the General Court was given supreme authority over the towns and their inhabitants.
While the Fundamental Orders of Connecticut cannot probably be considered a constitution in the modern sense, the Orders, nevertheless, served as the basis for government in Connecticut until 1662.

The first proposition—that the “Fundamental Orders” were “made and adopted by the people in mass meeting-”—seems to be contradicted by the “Orders” themselves, and by all the probabilities and circumstances then existing.
If the Fundamental Orders were a compact entered into and adopted by certain magistrates and committees acting as representatives of the three towns of Windsor, Hartford and Wethersfield, then it was a confederation, like that of the colonies after the Revolutionary War.
Their previous sovereign right to ‘dispose of lands is admitted and confirmed in the tenth order, which authorized the General Courts thereafter, “to dispose of lands undisposed of, to several towns or persons.” This recognizes and confirms the actions of the towns in the previous disposing of lands within their own bounds.

As Winthrop and his colleagues such as Thomas Hooker, the Mathers and other Puritan divines reveal in their works, the Puritans who settled in New England combined a fundamental conservatism with an unhesitating radicalism in a way that was to become as paradigmatic for Americans as other aspects of their approach to life.
While many of the fundamental principles and basic ideas of Hobbes with regard to human nature and natural right are present, the Declaration is prudential but not pessimistic about the possibilities of human self-government, hence it does not accept the idea of absolute king of leviathan state required by the Hobbesian compact.
Instead, the Declaration sets forth the fundamental principles that define the character of the American people, their basic purposes, and the nature of good government for such a people.
