 Glaxo Sued Over Paxil Child Suicide Studies
The lawsuit alleges GSK "engaged in repeated and persistent fraud" by concealing the negative results of five trials of Paxil on children and misrepresenting the data it did reveal.
But GSK countered that the 1998 memo was "inconsistent with the facts" and did not reflect the company's position.
GSK was still misrepresenting the results in letters to doctors into the middle of last year, it is alleged, as the US Food and Drug Administration was examining the issue of adolescent patients' suicidal thoughts.

The withdrawal of three of GSK's Paxil patents is unlikely to affect the predicted revenues of Paxil, as paroxetine remains under patent until 2006 and is therefore interpreted as a gesture to comply with the new legislation.
By giving up 3 of its less important patents, GSK may hope to improve its chances of hanging on to the ones that are delaying Apotex's generic release.

In the summary judgment ruling, the court ruled in GSK's favour that its patent expiring in December 2002 was valid, but ruled in Teva's favour that a GSK patent expiring in 2018 was invalid.
