Tenet, George, CIA Dir. v. Doe, John, et ux. - Medill School of Journalism - On the Docket
Their lawyer, Steven Hale, of Perkins Coie in Seattle, WA, obtained security clearance to handle the case and requested a meeting with Agency personnel and copies of Agency regulations governing the appeals process, copies of the PL-110 rules and numerous other documents and information.
Rehnquist reasoned that suits such as Doe's would make the government vulnerable to “graymail,” by inducing the CIA to settle out of fear that litigation would reveal classified information, and require it to invoke the privilege on a case-by-case basis, risking the perception that it is either confirming or denying relationships with plaintiffs like Doe.
