Susan Freer (formerly Burns), a lesbian mother in Georgia, is prohibited by court order from visiting with her children because she lives with her partner without the benefit of marriage.
Focusing only on whether Susan and her partner are married, the Court of Appeals ruled that a civil union is not a marriage in Vermont or in Georgia, and that even if Susan and her partner were married under Vermont law, Georgia law would prohibit recognition of the marriage.
