Girard devised and bequeathed his entire residuary estate to the City of Philadelphia in trust for the creation of an "orphan establishment." In furtherance of the deceased's wishes, Girard College was established as an institution for orphan children in Philadelphia.
It is not disputed, however, that Girard College is excluded from Sub-section [1] of the class certification because it is not a public school as defined by Section 198(a)(1) of the Elementary and Secondary Education Act of 1965.
Although it was Girard College which had discriminated against the African- Americans in refusing to admit them to the orphanage, the Court found the Board was acting as a trustee based on the power and authority given to it by state law, and therefore responsible under the Fourteenth Amendment for the College's action.

Stephen Girard left donations to schools, hospitals, Masonic poor funds, for fuel for the poor, and other charitable purposes ; but the major part of his for-tune went in trust to the city of Philadelphia, partly to improve its streets and the Delaware River front, but the greater portion to endow Girard College.
The College building is of white marble, and the finest specimen of pure Grecian architecture in the United States.
Opposite Girard College are the magnificent buildings of the German Hospital and the Mary J. Drexel Home for the education of nurses, established by the munificence of John D. Lankenau, the widowed husband of the lady whose name it bears.

During Milligan's final year at Girard, Alonzo Knight, a former student of Girard from the class of 1870 and the second of the thirteen from Girard who played in the majors, brought in the Philadelphia Athletics to show the youngsters how to play baseball.
He never forgot Girard, and when he was free on Founder's Day (Stephen Girard's birthday, May 20, or the closest Saturday to May 20), he would enter the gates of the school that served him well to pay homage to the Founder.

In 1859, Girard returned to Europe and in 1861 was awarded the Cuvier Prize by the Institute of France for his natural history work in the New World.

In 1896, construction of the thirteen story Stephen Girard Building at Girard and 12th Streets began and when completed it was expected that the Board’s offices would move there from 120 S. Third Street, the building rented to the Girard National Bank and formerly the banking house of Stephen Girard.

In another public arena, the admissions policy of Girard College became one of the significant tests of school segregation in the City of Philadelphia.
Under the will, Girard having "sincerely at heart the welfare of the City of Philadelphia" left the principal part of his estate to "the Mayor, Alderman and citizens of Philadelphia, their successors and assigns" money for a number of charitable purposes of which the school was one.
Although not part of the Philadelphia public school system, Girard College was administrated by the Board of City Trusts on behalf of a public entity that is required to abide by federal laws.

Today, 90% of the funding for the college is still generated by revenues from the Girard estate.
