The Goodyear company began producing bicycle tires but soon became involved in the new automobile industry and innovative ideas enabled the company to become the world's biggest tire supplier by 1916.
The company continued to grow in the US through innovative products but in the mid-1960s the company began to expand internationally and decided to enter Grand Prix racing in 1965 and scored its first win with Ritchie Ginther's Honda in the 1965 Mexican Grand Prix.

Goodyear argues there was no "competent evidence" it had knowledge or could have reasonably discovered the tire was dangerous at the time it entered the stream of commerce, or the lack of warning proximately caused plaintiff's injuries.
Goodyear's claim there was no "competent" or "admissible" evidence the tire in question was dangerous at the time it was sold is, in essence, a challenge to the admission of its memos and the five patents, as well as another attack upon the admission of Ewer.
Goodyear contends the trial court abused its discretion in refusing to enter remittitur of the compensatory damages award claiming it exceeds fair and reasonable compensation for plaintiff's injuries, as it exceeds his economic damages by $3.2 million, and claiming it is out of line with similar cases.

Orion Tire Corporation v. Goodyear Tire & Rubber Company, Inc.
Goodyear argues that even if the district court erred in failing to consider the statutory question, we should affirm dismissal of the RICO claim because amendment would be futile.
Goodyear argues that the district court lacked diversity jurisdiction over CTHL' s state law claims, and that, in the alternative, the forum non conveniens dismissal was proper.
Goodyear contends that the district court lacked diversity jurisdiction over CTHL' s state law claims against it because as a citizen of a British Dependent Territory ("BDT"), CTHL is not a "citizen or subject of a foreign state" within the meaning of 28 U.S.C. 1332(c)(1).

Goodyear states that by construing the word "tire" as meaning truck tire, the court erroneously selected a purchaser of truck tires as the "ordinary observer" from whose viewpoint infringement is determined.
Goodyear argues that a purchaser of tires in general is a less discriminating and thus more ordinary observer than a purchaser of truck tires, and that the district court was led, by this error in claim construction, into the erroneous finding of non-infringement.

Yet, Goodyear was determined to fix rubber's flaws and worked doggedly for the better part of a decade to find a reliable formula for what is now known as vulcanization—the process by which rubber is made impervious to heat and cold.
Then sometime in early 1839 one of Goodyear's experimental mixtures of rubber, sulfur and white lead accidentally found its way onto a hot stove, and instead of melting, hardened to the consistency of tough leather, exactly the transformation he had been searching for.
By the time Goodyear left Philadelphia for Connecticut in 1836 he was obsessed with rubber—cutting it up, heating it and mixing it with assorted chemicals in an effort to make it smoother and more resistant to extremes in temperature.

On appeal, Goodyear contended that the pay discrimination claim was time barred with regard to all pay decisions made before September 26, 1997—180 days before Ledbetter filed her EEOC questionnaire—and that no discriminatory act relating to her pay occurred after that date.
She argues simply that Goodyear’s nondiscriminatory conduct during the charging period gave present effect to discriminatory conduct outside of that period.
Because Ledbetter has not adduced evidence that Goodyear initially adopted its performance-based pay system in order to discriminate based on sex or that it later applied this system to her within the charging period with discriminatory animus, Bazemore is of no help to her.

According to Azcuenaga, the decision to grant the relief to Goodyear and deny it to the other four respondents appears to be inconsistent with recent precedent and with the Commission's announced Sunset Policy where it is presumed "that the public interest requires reopening and setting aside the order in its entirety...
