However, the Special Rapporteur was extremely concerned by methods used by the police in Gostivar during a violent confrontation with ethnic Albanian demonstrators that followed the removal of the flags by the police in the early morning hours.
Gostivar’s decision was contested before the country’s Constitutional Court, which decided on 21 May 1997 temporarily to suspend the disputed policy and ordered the flags to be removed pending a final judgement in the case.
The tragic clash between police and demonstrators at Gostivar on 9 July 1997, in which three persons were killed and many others injured, involved an excessive use of force by the police of the former Yugoslav Republic of Macedonia.

Gostivar is one of the largest cities in western Macedonia, and has an ethnically mixed population.
In such a melee as there was in the center of Gostivar, it is difficult to determine if and when the police met all of the legally prescribed conditions before resorting to force, or whether the force used was within the amount allowed by law.
Biljali's personal opinion, the police action in Gostivar was brutal and unnecessary, although he also disagrees with the "radical approach" of the Albanian politicians of the DPA in Tetovo and Gostivar.

After receiving the protest note of the Albanian Government with which protest is being expressed against the events in Gostivar and Tetovo and the Macedonian authorities are being accused for causing the riots, an answer was sent by the Foreign Ministry of the Macedonian Republic last Friday.
The Albanian note, as it is said in the reply, exceeds the frameworks of the legitimate interest of any state regarding the position of the minorities and presents an act of direct interference in the domestic issues of the Macedonian Republic.

The SR noted police methods in Gostivar during a confrontation with ethnic Albanian demonstrators which resulted in the deaths of three people and injuries to approximately 200 others.
The SR noted that as at the end of the August 1997 the government was conducting an inquiry to determine whether police exceeded their authority and that, in September 1997, the Parliament decided to establish a "survey commission", operating independently of government and mandated to report its findings within 30 days after its creation.
The report addresses the right to foster cultural identity and the sensitive issue of flags, recalling that the events in Gostivar were the culmination of a controversy over the issue of the use of flags as cultural symbols.

The riots in Gostivar which did not continue in the following days, and clashes between the police and Albanians in Tetovo, have to be seen against the background of the tensions which have arisen in recent months regarding the use of the flags of the various nationalities.

 Human Rights Groups Criticize Macedonian Court (Human Rights Watch, 21-2-1998)
On January 27, 1997, the city councils in Tetovo and Gostivar, two predominantly ethnic Albanian towns in western Macedonia, voted to raise the Albanian and Turkish state flags next to the Macedonian state flag outside of the cities' town halls.
The Macedonian Ministry of Interior informed the Tetovo and Gostivar governments that their decision was illegal, but the city councils refused to take the flags down.
On May 21, the Macedonian constitutional court ruled that the city councils in Tetovo and Gostivar did not have the right to fly the Albanian or Turkish flags in front of their town halls.

In March a parliamentary commission published a report on the events in Gostivar in July 1997, when police shot dead two men and beat hundreds of ethnic Albanian demonstrators, causing the death of one man (see Amnesty International Report 1998).
The sentence of the President of the Gostivar municipal council, Refik Dauti, who was convicted at the same trial, was reduced from three to two years' imprisonment.
