  2001 Annual Government in the Sunshine Act Report
The agency's Sunshine rules delegate to the Commissioner assigned to present an agenda item at an open meeting the authority to make public, before the meeting, material "sufficient to inform the public of the issues likely to be discussed in connection with that matter." Commission Rule 4.15(b)(3).
The Sunshine Act provides that a meeting may be closed if one of the exemptions in 5 U.S.C. § 552b(c) applies, unless "the agency finds that the public interest requires otherwise." The members of the Commission consider the public interest in each vote concerning the open or closed status of a meeting.
Sunshine Act Exemption 3(B) covers materials that are exempted from disclosure by a statute that establishes criteria for withholding the information, or refers to particular types of matters to be withheld.

The purpose of the rule is to bring the NRC's Sunshine Act regulations, and the way they are applied by NRC, into closer conformity with Congressional intent, as set forth in the legislative history of the Sunshine Act and as clarified in a unanimous Supreme Court decision, FCC v.
These kinds of ``non-Sunshine Act discussions,'' which can be an important part of the work of a multi-member agency, had been foreclosed at NRC since 1977 by the agency's unduly restrictive interpretation of the Sunshine Act.

 ANNUAL REPORT: Government in the Sunshine Act
Section 7A(h) of the Clayton Act, 15 U.S.C. 18a(h), prohibits the Commission from disclosing this information publicly except as may be relevant to an administrative or judicial action or proceeding.
Each of these meetings was closed pursuant to Section (d)(4) of the Sunshine Act, which permits the Commission to close a meeting with less than the normal seven days' notice if the Commission has issued regulations for expedited procedures.
Although the Sunshine Act does not specifically address the notice required for deleting an item from the agenda of a meeting closed under Exemption 10 of the Act, the Act does contemplate that changes in a meeting's agenda may occur after public notice has been provided.

Government is and should be the servant of the people, and it should be fully accountable to them for the actions which it supposedly takes on their behalf.
At the time of the enactment of the Sunshine Act, it was assumed that once a closed meeting was held, most or all of it would turn out to be nonexempt, and the transcript would be made available in lieu of attending the meeting.
One of the problems with the Sunshine Act is that it was designed to protect against an evil that does not appear to have existed at the time of enactment.

The Commission's decision to take action with regard to the Sunshine Act was a reflection of its longstanding efforts to increase the collegiality of the Commission process, to ensure that its procedures and practices are in conformity with current law, and to reach closure on outstanding items.
At the time that the Commission first put its Sunshine Act rules into place, it acknowledged that briefings might be exempt from the Sunshine Act's scope, but said that the Commission did so much of its important work in briefings that as a policy matter, it believed these should be open to the public.
Accordingly, the NRC intends to implement its 1985 Sunshine Act rules and to begin holding non-Sunshine Act discussions, subject to the conditions outlined in the May 10, 1999, document, and as further clarified in the present document, 30 days from the date of this notice.

The longest pending federal Freedom of Information Act was filed during the Reagan administration, 20 years ago, in 1987, according to the Knight Open Government Survey from the National Security Archive at George Washington University.
