If incentives for private market regulation are weak or if market participants lack the capabilities to pursue their interests effectively, then the introduction of government regulation may improve regulation.
We must be aware that government regulation unavoidably involves some element of moral hazard--if private market participants believe that government is protecting their interests, their own efforts to protect their interests will diminish to some degree.
Before evaluating the current regulation of derivatives in light of these considerations, it is quite useful to know something of the history of these instruments and their regulation.

Government mandated regulatory compliance costs are huge amounts: as much as all spending by state and local governments (education, police, welfare, etc.), or twice as much as social security and Medicare spending, or 3 times more than national defense.
The larger the section of the economy that is consumed by government spending, and the higher the regulatory costs mandated, the smaller the effective share of the economic pie remaining to the 'free-market private' sector.
Most agree the private sector (not the government sector) is the prime generator of long-term real median family incomes, living standards, real private savings and freedom.

Even as billions of dollars are spent each year on government secrecy, the classification and personnel security systems have not always succeeded at their core task of protecting those secrets most critical to the national security.
The tendency of individuals in a government agency to protect too much by erring on the side of secrecy will not change through mere exhortation, but only as a result of common principles that are grounded in statutory language.

The literature on outsourcing government services recognizes this distinction when it notes that it is easier to contract for government services in cases where the parameters of a vendor's performance can be clearly specified in advance.
This means it is easier for the government to contract for garbage pickup than for private prisons because the former function does not require discretionary judgments by private employees in circumstances in which it is difficult to specify in advance how the employees should act.
To ensure that the government's interests are properly implemented, the government would have to be in continuous negotiation with the private contractor, which makes it less expensive to have these activities done within the government in the first place.

Their motivation seems to stem in part from a generalized distrust of government and I suppose to this extent they partake of the spirit of the times.
In contrast, it might be argued that the need for government regulation in the nonprofit sector is slight since those who work in the nonprofit sector are presumably motivated to seek the good of others.
Rather, the "us" is understood as a combination of the government regulators and the myriad of those who work for nonprofits that do not abuse their public trust and the "them" is the very small number that do.

AB 1302 (Horton) - gives the Office of Administrative Law the ability to review regulations put forth by state agencies for their impact on small business.
Regulation at all levels of government is a major issue for small businesses.
We do however want to have input on regulations that are put forth by state agencies and we want the regulations put forth in understandable terms, have reasonable timelines, at a cost that will input small businesses the least.
