Mr Jaitley said a governor is appointed at the “pleasure of the President” for five years and if his term is ended mid-way “some solid reasons” have to be in place.

The dismissal of the NDA-appointed governors of Uttar Pradesh, Haryana, Gujarat and Goa was not unexpected as the United Progressive Alliance (UPA) government had given indications that it would wield the axe if they did not quit on their own.
The legality and propriety of the dismissal of governors, who have been appointed for a five-year term are a matter of debate, with different views being expressed on whether the President’s “pleasure”, on which a governor’s appointment and tenure are based, can be withdrawn arbitrarily.
The basic problem is that governors are appointed by governments to work as agents of the party in power at the Centre and not to serve as representatives of the President.

A Public Interest Litigation was filed today in the Supreme Court challenging the removal of four governors by the President and terming the Congress party-led coalition government's decision in this regard as 'unconsitutional'.

The Sarkaria Commission noted, for instance, that of 298 Governors appointed between 1967 and 1986, only 18 completed their full five-year term: 88 lasted less than a year, 71 for one year, 55 for two years, 40 for three years and 26 for four.
One consequence of this has been a rekindling of the debate on the raison d’ĂȘtre of the office of Governor and the natural reference to the Constitution-makers’ wisdom or lack of it for foisting on the poor tax-payer a bunch of white elephants.

The two main parties — the Congress and the BJP — have been engaged in a war of words on the issue and the familiar charges are expected to be traded again in Parliament tomorrow.
The BJP view is that a Governor enjoys a "fixed tenure" of five years and unless there is a specific charge of misconduct against him the President cannot "withdraw his pleasure" and sack him.
Senior BJP leaders have also said that the Vajpayee Government had tried to put a new norm in place and create a new precedent by not touching the Governors appointed by the previous regime, except in those cases where new appointments were made after the notification of elections.
