A highway-railroad grade crossing is an intersection where a roadway crosses railroad tracks at the same level (referred to by civil engineers as the same “grade”).
Public crossings are those at which the highway or roadway is under the jurisdiction of and maintained by a public authority such as a municipality, county, or State agency.
Private crossings are those in which the roadway is privately owned, as you might find on a farm or within an industrial complex, where the road is not intended for public use and is not maintained by a public authority.

 FRA Assesses Fines Against CSX Transportation Totaling $227,000 for Safety Violations at Highway-Rail Grade Crossing
FRA is assessing the statutory maximum of $27,000 for interference with the normal functioning of a grade crossing warning system that resulted in an activation failure, plus $5,000 for each of 30 counts for not reporting the activation failure within the required 15-day period.
From 1995 to 2004, the number of grade crossing collisions declined by 34 percent, the frequency of such collisions per million train miles decreased by 42 percent, and the number of fatalities fell by 36 percent.
During the first 11-months of 2005, grade crossing collisions are down 5.1 percent and fatalities have declined 5.3 percent compared to the same period of 2004.

The bus had stopped at the grade crossing and was hit in the right front as it pulled out in the path of the approaching Southern Pacific train.
As the train neared the crossing, crew members noticed the approaching school bus and applied the emergency brakes at a distance of about 100 feet from the crossing when it was apparent the bus would not stop.
