Under common law, larceny is the trespassory taking and asportation of the (tangible) personal property of another with the intent to deprive him or her of it permanently.
Although the mens rea of larceny is the intent to steal, the focus is on the loss to the possessor, not the gain to the defendant.
Grand larceny is often classified as a felony with the concomitant possibility of a harsher sentence.

DOYLE, J. This appeal is from a judgment of conviction rendered on the verdict of a jury finding the defendant, Charlie Holland, "guilty of grand larceny as charged in the information," and fixing his punishment at imprisonment for a term of 1 1/2 years.
The Attorney General concedes that for the reasons stated the evidence is insufficient to sustain a conviction for grand larceny, but recommends that this court so modify the judgment, in respect to the punishment, as to make the same the maximum punishment prescribed for petit larceny.

Instead of providing different degrees of grand larceny, the legislature set forth five different ways or methods by which grand larceny might be committed, stealing property of any value by taking the same from the person of another being one of them.
The appellant in this case was charged with an act which constitutes one of the methods by which grand larceny may be committed, and the value of the property stolen is not an element of the offense.

Since the crime must be larceny from the person, and larceny from the person under section 1704 is one of the two alternatives which makes larceny grand larceny, no requirement that the value of the property exceed $50 exists.

At common law, theft of timber, for example, is not larceny because the timber has never been personal property in the possession of the owner or tenant.
At common law, trade secrets are not personal property subject to larceny because a trade secret is considered an intangible idea or plan.
It is the opinion of the Commission, however, that section 1732 does not create a separate crime, larceny of trade secrets, but simply clarifies the meaning of personal property as given by 21 O.S. Hence, the element instructions on grand and petit larceny encompass larceny of trade secrets.

Sullivan County sheriff's deputies charged Reule with an additional count of third-degree grand larceny, also a felony, and first-degree identity theft.
Reule pleaded guilty in June to identity theft and grand larceny.
