As of March 5, 2004, EMI has sent cease and desist letters to those who are posting the Grey Album as part of the Grey Tuesday online protest, and Sony/ATV has sent a DMCA "takedown" notice to at least one ISP.
Because fair use demands a case-by-case consideration of the particular facts surrounding any defendant, and because there is little case law addressing a situation like the one presented by Grey Tuesday, it is difficult to predict the outcome of any particular case.
It is clear, however, that Grey Tuesday protesters have a credible fair use defense to any copyright claim by Sony/ATV.

Downhill Battle seems to be on a roll, they have a new project called Grey Tuesday where they ask sites to post the mp3s from the Grey Album to their websites on February 24th.
That said, I think the point of the Grey Tuesday project is for EMI and the RIAA to see who gives support.
If your position on matters of copyright were well thought out you wouldn't have proposed to participate on Grey Tuesday in the first place, or you would still continue to be a supporter of Grey Tuesday.

In fact, I'm not sure that something like The Grey Album, which borrows so heavily from the White Album should not require obtaining a license from the copyright owner.
I don’t, however, think that people should be able to take large portions of another’s work when that person clearly intends to enforce their rights in, for example, a famous album that is less than 40 years old.

I decided to participate in Grey Tuesday because I think there's some ground to be covered that hasn't been covered, and quite frankly I fear that the record companies would swoop in and do the old dinosaur dance if no one intervened.
Incidentally I think both the The Grey Album and Bittersweet Symphony rock and that they are highly creative and I fail to see exactly what reward the owner's of Beatles music being cheated out on by The Grey Album.
While I may not agree with the means by which these issues are being raised (through Grey Tuesday or whatever), I do believe that these issues need to be dealt with and are not satisfactory at the moment.

In any case, the Grey Tuesday issue is not about Big Bad Record companies, it's about whether an independent artist should retain the right to decide when their work can be commercially sampled by another, and whether she can negotiate her own terms.
Note that I did not justify the Grey Album as is. The Grey Album actually is a fairly difficult case, there are complicated issues of fair use involved.
I gave a listen to the Grey Album, and even though the idea is fun, I thought it was a pretty mediocre listen.
