The Samuel Griffith Society: Volume 4: Chapter Nine
The Australian Capital Television Case establishes that the Australian people enjoy a right of political communication and discourse that parliaments are powerless to take away.
Australians have much to be proud of in this connection, and indeed, in the early part of the century, political science textbooks the world over treated the Australians as being second only to the Swiss as innovators of practical democratic reforms.
Although that Australian democratic spirit is still there, and at least as strong as in 1901, it has since then almost ceased to find any outlet in proposals for reform of Australian constitutional structures.
