In May 1997, freight railroad operator Guilford Transportation Industries announced its intent to acquire certain of Amtrak's rail operations in the northeast.
Guilford and its owners sued Wilner for defamation, claiming that the column falsely portrayed the company as hostile to organized labor and implied that it had violated the Railway Labor Act (RLA) by causing labor unrest and strikes.
The court reached a similar conclusion with respect to Guilford's claim that it was defamed by the implication that it had violated the labor act.

Shippers on the Guilford Rail System are expressing frustration with the shortline's service and have organized to press for changes, including urging Maine legislators to increase scrutiny of rail operations in that state, reports Argus Rail Business newsletter.
The service complaints lobbied against Guilford mirror problems faced by some of the Class Is. As increased economic activity in the past year pushed higher traffic volumes onto the rails, carriers, including CSX and UP, struggled to marshal the crews and power needed to haul the freight.
But, Guilford Executive Vice-President David Fink told the House of Representatives Utilities and Energy committee in February that 2004 "was our best year in the last 20." Guilford dispatches Amtrak service to Portland, Maine, with one of the nation's best on-time performance records, he said.

Morgan announced today that the Board has issued a decision addressing "preemption" issues in a case in which the Town of Ayer, Massachusetts (Ayer), is at odds with The Boston and Maine Corporation, Springfield Terminal Railway Co., and Guilford Transportation Industries, Inc. (collectively, "Guilford").
Congress broadened the preemption provision of the law in the Staggers Rail Act of 1980, and further in the ICC Termination Act of 1995 (ICCTA) to such an extent that the courts have found most state and local regulation of transportation and transportation facilities to be preempted.
Therefore, Guilford went to federal district court for a declaration that federal law preempted the local laws that Ayer and its agencies sought to apply.
