Sayer Trial Pierre Guillaume Sayer and 3 other MÉTIS in the RED RIVER COLONY were brought to trial on 17 May 1849 in the General Quarterly Court of Assiniboia on charges of violating the HUDSON'S BAY CO's charter by illegally trafficking in furs.
A jury of 7 English speakers and 5 French speakers heard evidence proving Sayer's guilt but indicating HBC encouragement to itinerant traders in border regions.
When Sayer and his supporters emerged "free" from court, gunfire as a feu de joie and shouts of "le commerce est libre" greeted them.

Although the HBC maintained a monopoly on the fur trade during the early-mid 19th century there was competition from James Sinclair and Andrew McDermot (Dermott), independent traders in the Red River Colony.
One major event that lead to the demise of the HBC's monopoly in Rupert's Land was the Guillaume Sayer Trial in 1849.
Sayer, a Métis trapper and trader, was accused of the illegal trading of furs and brought to trial by the Court of Assiniboia, which was heavily stacked with either HBC officals or HBC supporters.

 Louis Riel - Wikipedia, the free encyclopedia
Riel was the eldest of eleven children in a locally well-respected French Canadian-Métis family—his father had gained prominence in this community by organising a group that supported Guillaume Sayer, a Métis imprisoned for challenging the HBC's historical trade monopoly.
Sayer's eventual release as a result of agitations by Louis Sr.'s group is credited with ending the monopoly, and the name Riel was therefore well known in the Red River.
His mother was the daughter of Jean-Baptiste Lagimodière and Marie-Anne Gaboury, one of the earliest white families to settle in the Red River Settlement in 1812.

Sayer and McGillis were from Grantown McGillis being a brother-in-law of Grant.
The case came up for trial on May 17, 1849 with Sayer the first of the four to enter the dock.

It is interesting to observe that one of the witnesses for the defence was Louis Riel, active in the Sayer rising and father of the leader of the insurrection, 1869, dit L'Irelande [sic], and that Pelly conducted his own defence and questioned witnesses.
But the significant matter for our inquiry is that the defendants, at the opening of the trial, objected to the formation of the court, as Thom was sitting as a judge in a case in which he earlier acted as attorney for the plaintiff, an objection that was overruled by the court.
The disturbances at the time of Sayer's trial in 1849 have already been referred to, and in 1850 it was directed that two constables be in attendance at each of the magistrate's courts during the sittings.

Louis Sr, an educated man, had obtained land on the Red River where he gained a position of influence in the Métis community.
In 1849 he organized the community to aid Pierre-Guillaume Sayer*, a Métis charged with violating the Hudson’s Bay Company’s trade monopoly.
Sayer was released, an action which resulted in the end of that monopoly.

On May 17, 1849, Pierre Guillaume Sayer and three other Metis from the Red River Colony were brought to trial on the charge of violating the Hudson's Bay Company charter by illegally trafficking in furs.
The four were found guilty, but the jury recommended clemency on the grounds that the Metis genuinely believed that they had the right of free trade.
Satisfied that the rights of the Company had been upheld, the Chief Factor requested that Sayer not be punished and withdrew charges against the other men.

The HBC tried to control all trading in the region, but independent merchants could not be stopped.
The issue was settled in 1849 when a Métis trader named Guillaume Sayer was brought to trial, charged with illegal fur trading.
He was convicted but was released without punishment; from then on the fur trade was open to anyone.

 Free Trade at Red River
Finally, after four years of seeing more and more of their trade leaving the country, and attempting to control matters by bringing in British troops, the new Chief Factor at Fort Garry, John Ballenden, chose to lay charge of illegal trafficking in furs on four Metis men: Guillaume Sayer, McGillis, Laronde and Goulet.
This was the beginning of the notorious Sayer trial which was to end any legal attempt to curb free trading in Red River.
The trial of Guillaume Sayer was also the trial of the old order which had held sway in Red River since the union of the companies in 1821.

He challenged no fewer than nine and their places were taken by Metis and half-breeds, some from the mob outside, who sat in the jury box with their powder horns at their sides.

When the crowd of MÈtis heard the verdict, they interpreted it as being an acquittal and promptly drew the conclusion that no one would be penalized for trading in furs.
The Sayer trial became much more significant than the trial of four men.

In 1836 when the first jury trial in Assiniboia found Louis St. Denis guilty of theft, he was sentenced to be flogged in public, but when this indignity was being administered, his friends stoned the floggers and set him free.
On another occasion when Adam Thom was Recorder (Judge) of Assiniboia, he found Guillaume Sayer and some others guilty of illegally trading in furs.
Therefore, when public demonstrations were mounted against it, Thom wisely dropped the case "in favor of the restoration of tranquillity in the settlement."
