Topic: Gun rights

Gun politics in the United States - Wikipedia, the free encyclopedia
Gun control advocates argue that only members of a "well regulated militia" have the right to keep and bear arms, with debate ensuing over what, exactly 'the militia' is. Opponents of gun control argue that the phrase "the people" applies to all individuals rather than an organized collective.
Another position taken by gun rights advocates is that an armed citizenry is the population's last line of defense against tyranny by their own government, as many believe was one of the main intents of the Second Amendment.
Gun control advocates dispute these ideas, arguing that the US's two neighbors, Mexico and Canada are unlikely to ever invade, and that conquering tyrants have often required firearms ownership among their civilian populations (and, needless to say, their militaries).

Gun control advocates excuse the intrusive imposition of a registration requirement by arguing that it is merely a reasonable precaution similar to the registration of privately-owned motor vehicles—the primary counterpoint being vehicle ownership's lack of explicit Constitutional protection.
John Lott, claim to have discovered a positive correlation between gun control legislation and crimes in which criminals confront citizens - that is, increases in the number or strictness of gun control laws are correlated with increases in the number or severity of violent crimes.

In what observers are calling a novel approach against gun control, two groups have launched a petition drive to force the Department of Justice to enforce gun rights with the same zeal it enforced civil rights in the 1950s and 1960s.
"A basic, protected right is being blatantly and severely infringed upon by unconstitutional edicts, bearing the name and form of law, that are oppressively enforced by the executive and judicial authorities of this state," said the petition.
Gun Owners of America, agreed with Puckett, noting that constitutionally, it is a congressional duty to "call forth the militia" in defense of the U.S. homeland.

Ostensibly passed to crack down on outlaws such as Miller and Layton, the law was controversial, since it limited gun rights for all Americans.
The charges against Miller and Layton were dismissed in district court, on the grounds that the National Firearms Act violated states’ rights and the Second Amendment.
Even so, liberal law professor Sanford Levinson notes that Miller can be construed to mean "that the individual citizen has a right to keep and bear bazookas, rocket launchers, and other armaments that are clearly relevant to modern warfare…" This is a far cry from the Brady Center’s interpretation.

Speaker, the most disturbing aspect of these lawsuits is the idea that guns, which are inanimate objects, are somehow responsible for crimes.
