On 1 April 2006, responsibility for health and safety policy and enforcement on the railways transferred from HSC/E to the Office of Rail Regulation (ORR).
HSC Chair Bill Callaghan thanked HSE Railways for their work at HSE in a speech on the transfer of responsibility for railway health and safety to the Office of Rail Regulation.

HM Railway Inspectorate (HMRI: His/Her Majesty's Railway Inspectorate) is the British government body responsible for overseeing safety on Britain's railways, tramways and other guided transport systems.
Britain's railways at that time were large monopolistic private companies, so the BoT was concerned with competition; and the HMRI was formed to safeguard the public (not railway employees).
The function of HMRI is to inspect and approve all new (or modified) railway works and to investigate railway accidents.

The South Tynedale Railway is a 2ft (61cm) gauge line, running northwards from the Alston terminus along the former Alston-Haltwhistle branch alignment.
Following approval from HM Railway Inspectorate in early September 1999, the Railway is now open a further mile to Kirkhaugh (2.5 miles from Alston).
The original standard-gauge railway was a branch from the Newcastle-Carlisle line; falling victim to BR cuts, this branch was closed in 1976, the rails being torn up and sold as scrap immediately following the closure.

In addition to 27 railway fatalities - 12 of which were suicides - the report said one passenger died after falling down stairs at Glasgow Queen Street station and a pedestrian was struck and killed by a train while using a level crossing in Aberdeenshire.

Representatives attended a recent Heritage Railways Association meeting in Birmingham at which HM Railway Inspectorate gave a presentation on the proposed new railway safety regime.
It is intended that "low risk" railways such as the Talyllyn should be covered by a general exemption from the full application of the proposed new regime, subject to a requirement for a documented safety management system.
There was a brief discussion of how we might celebrate the Society's Diamond Jubilee in 2010/11 and the Railway Company's 150th anniversary in 2015; however this far ahead there were no volunteers for a working group, so we intend to return to the subject in a year's time.

The Railway Inspectorate has its origins in the 1840s, and for many years was part of the Board of Trade.
Where there is loss of life or serious passenger injuries, or anything that would raise public concerns, the Railway Inspectorate hold their own formal inquiry, which is held 'in camera' until the Coroner's or Procurator Fiscal's inquests have been concluded.

One of Britain's senior railway engineers says that if the wrong type of nuts had been used on the points they could have worked loose and fallen off.

The HM Railway Inspectorate report into the Watford Accident highlights a number of safety concerns.
It will be seen from the forgoing paragraphs that considerable reference is made to the Watford Accident Report but that is simply because it is the most recent report and there is little reason to think that the problems highlighted are restricted to the one train operator involved in the accident.
I would ask that HM Railway Inspectorate give serious consideration to the proposals and discuss with Railtrack and the Train Operating Companies the possibility of trialing such a system.
